S.I. No. 10/2024 - Sick Leave Act 2022 (Increase of Statutory Sick Leave Days) Order 2024


Notice of the making of this Statutory Instrument was published in

I, NEALE RICHMOND, Minister of State at the Department of Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 6 of the Sick Leave Act 2022 (No. 24 of 2022) and the Enterprise, Trade and Employment (Delegation of Ministerial Functions) Order 2023 ( S.I. No. 14 of 2023 ), following consultation with the Minister for Social Protection and having regard to the matters specified in paragraphs (a) to (g) of section 6 (1) of the Sick Leave Act 2022 , hereby make the following order:

1. This Order may be cited as the Sick Leave Act 2022 (Increase of Statutory Sick Leave Days) Order 2024.

2. With effect from 1 January 2024, the number of statutory sick leave days to which an employee is entitled to in a year provided for in section 5 (2) of the Sick Leave Act 2022 (No. 24 of 2022) shall be up to and including 5.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

The purpose of this Order is to increase the minimum statutory sick leave days provided for under the Sick Leave Act 2022 from three days to five days. This will have the effect of ensuring that an employee with an entitlement to statutory sick leave will be entitled to up to and including five days’ employer-paid sick leave per year.
