S.I. No. 677/2023 - Tailte Éireann (Land Registry (Registration of Certain Charges)) (Fees) Order 2023


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 22nd December, 2023.

I, DARRAGH O’BRIEN, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by section 25 (1) of the Tailte Éireann Act 2022 (No. 50 of 2022), having consulted with the chief executive of Tailte Éireann and with the consent of the Minister for Public Expenditure, National Development Plan Delivery and Reform (as adapted by the Public Expenditure and Reform (Alteration of Name of Department and Title of Minister) Order 2023 ( S.I. No. 19 of 2023 )), hereby order as follows:

1. This Order may be cited as the Tailte Éireann (Land Registry (Registration of Certain Charges)) (Fees) Order 2023.

2. This Order shall come into operation on 1 January 2024 and shall cease to have effect on 31 December 2026.

3. In this Order, “Act of 1964” means the Registration of Title Act 1964 (No. 16 of 1964).

4. No fee shall be payable to Tailte Éireann in respect of an application to it for the registration of an entry of a charge created in accordance with section 62 of the Act of 1964 on the register (within the meaning of the Act of 1964) that –

(a) is lodged by electronic means in a manner approved by Tailte Éireann, and

(b) complies with any requirements specified by Tailte Éireann in respect of an application for such registration.

The Minister for Public Expenditure, National Development Plan Delivery and Reform consents to the making of the foregoing Order.
