S.I. No. 540/2023 - Statutory Instrument to Increase Fixed Payment Notices Under the Control of Dogs Act 2023


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 14th November, 2023.

I, HEATHER HUMPHREYS, Minister for Rural and Community Development, in exercise of the powers conferred on me by sections 27 , 28 and 31 of the Control of Dogs Act 1986 (No. 32 of 1986), hereby make the following regulations:

1. These Regulations may be cited as the Control of Dogs (Amendment) Regulations 2023.

2. (1) These Regulations shall come into operation on 1st December 2023.

(2) In these Regulations, “Principal Regulations” means the Control of Dogs Regulations 1998 ( S.I. No. 442 of 1998 ).

3. A breach of Article 5(2) of the Principal Regulations shall be an offence to which section 28(1) applies.

4. The Control of Dogs Regulations 1998 (S.I. No. 442/1990) are amended by the substitution of the following Regulation for Regulation 10:

“10. The prescribed amounts for the purpose of section 28(1) of the Act are as follows:

(a) €150, in respect of an offence referred to in section 27(1)(a),

(b) €300, in respect of an offence of failing to comply with section 9(1), referred to in section 27(1)(b),

(c) €250, in respect of an offence of failing to comply with section 10, referred to in section 27(1)(b),

(d) €150, in respect of an offence of failing to comply with section 13, referred to in section 27(1)(b),

(e) €150, in respect of an offence referred to in section 27(1)(c),

(f) €300, in respect of an offence being a breach of Article 5, referred to in section 27(1)(f) and

(g) €200, in respect of an offence being a breach of Article 6(1) or (2), referred to in section 27(1)(f).”.
