S.I. No. 446/2023 - Statistics (Monthly Survey of Construction) Order 2023

I, LEO VARADKAR, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) and for the purpose of giving full effect to Regulation (EU) 2019/2152 of the European Parliament and of the Council of 27 November 20191 in so far as it relates to paragraphs 1(a) and subparagraphs (i) and (l) of paragraph 2 of Article 6 thereof, as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 20212 , hereby order as follows: | ||
1. (1) This Order may be cited as the Statistics (Monthly Survey of Construction) Order 2023. | ||
(2) This Order shall come into operation on 1 January 2024. | ||
2. (1) In this Order – | ||
“Regulation” means Regulation (EU) 2019/2152 of the European Parliament and of the Council of 27 November 20191 , as amended by Commission Delegated Regulation (EU) 2021/1704 of 14 July 2021;2 | ||
“Regulation (EC) No. 1893/2006” means Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 20063 as amended by Regulation (EC) No. 295/2008 of the European Parliament and of the Council of 11 March 20084 , Regulation (EU) No. 70/2012 of the European Parliament and of the Council of 18 January 20125 and Regulation (EU) 2019/1243 of the European Parliament and of the Council of 20 June 20196 ; | ||
“survey” means the Monthly Survey of Construction that is conducted by the Central Statistics Office for the purposes of obtaining from persons or undertakings to which this Order applies information specified in the Schedule, including for the purposes of compliance with the Regulation. | ||
(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, other than where the context otherwise requires. | ||
3. This Order applies to a person who, or an undertaking (other than a public authority) that, is classified for statistical purposes under section F of NACE Rev 2 set out in Annex I to Regulation (EC) No. 1893/20063 . | ||
4. A requirement on persons or undertakings to which this Order applies to provide, for the purposes of the survey, monthly and in relation to the immediately preceding month in the period commencing from 1 February 2024 and ending on 31 January 2029, information the general nature of which is specified in the Schedule, is hereby prescribed. | ||
SCHEDULE | ||
Article 4 | ||
1. Information regarding the following, as it relates to the person or undertaking concerned and specifying the month to which the information relates: | ||
(a) the nature of the business; | ||
(b) the number of persons engaged in the undertaking or by the person in the month concerned; | ||
(c) the value of construction work, including repairs and maintenance, done in the month concerned – | ||
(i) excluding the value of such construction work by subcontractors (other than labour only subcontractors) for the person or undertaking concerned, or | ||
(ii) where the value of work referred to in subparagraph (i) cannot be excluded, the estimated percentage contribution of the work referred to in subparagraph (i) to the value of such construction work. | ||
2. Information on the time taken by the persons or undertaking concerned to complete the questionnaire, form or other record prepared by the Director General for the collection of the information referred to in paragraph 1. | ||
