S.I. No. 378/2023 - National Fertiliser Database Regulations 2023

I, CHARLIE MCCONALOGUE, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by sections 7D (10) and (11) (as inserted by section 61 of the Veterinary Medicinal Products, Medicated Feed and Fertilisers Regulation Act 2023 (No. 21 of 2023)) and 11 of the Fertilisers Feeding Stuffs and Mineral Mixtures Act 1955 , hereby make the following regulations:

1. These Regulations may be cited as the National Fertiliser Database Regulations 2023.

2. (1) The time or times prescribed for a person entered in the Fertiliser Economic Operators’ Register to submit information to the Minister for the purposes of section 7D (2) of the Fertilisers Feeding Stuffs and Mineral Mixtures Act 1955 is:

(a) for a fertiliser economic operator who has brought fertiliser into the State, provide the information specified at section 7D (3)(a) other than subparagraphs (iv), and (v), no later than 72 hours after the fertiliser is brought into the State;

(b) subject to subparagraph (c), for all fertiliser economic operators, the details required under Section 7D (2) shall be made for each calendar month, the submission to be made on or before the 15th day of the subsequent month for which the data being submitted relates to;

(c) for all fertiliser economic operators, the details required under Section 7D (2) shall be made for the months of September, October and November 2023, the submission to be made on or before the 15th day of December 2023;

(d) for all fertiliser economic operators, the details shall be submitted for stocks of fertiliser products on his or her premises or under his or her control at 23.59 on the 30th day of September each year, the submission, including a nil declaration where appropriate, to be submitted by the 15th day of October of that year.

(2) Subparagraphs (a), (b) and (c) of paragraph 1 apply from 1 September 2023.

3. (1) The time or times prescribed for a person entered in the Professional Fertiliser End Users’ Register to submit information to the Minister for the purposes of section 7D (6) of the Fertilisers Feeding Stuffs and Mineral Mixtures Act 1955 is, for all professional fertiliser end users, the details shall be submitted for stocks of fertiliser products on his or her premises or under his or her control at 23.59 on the 14th day of September each year, the information, including a nil declaration where appropriate, to be submitted by the 15th day of October of that year.

(2) The submission shall include, where relevant, the information specified at section 7D (7)(e)(i) of the Fertilisers Feeding Stuffs and Mineral Mixtures Act 1955 relating to the quantity of third party fertiliser product.

4. The form and manner of a submission shall be compatible with the National Fertiliser Database as defined in section 7D (1) of the Fertilisers Feeding Stuffs and Mineral Mixtures Act 1955.

These Regulations set out the reporting obligations of all Fertiliser Economic Operators and Professional Fertiliser End Users regarding imports into the state, declaration of annual closing stocks and submission of sales data.
