S.I. No. 374/2023 - Affordable Housing Act 2021 (Cost Rental Eligibility) Regulations 2023

I, DARRAGH O’BRIEN, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by sections 3 and 31 (3)(b) of the Affordable Housing Act 2021 (No. 25 of 2021), hereby make the following regulations:

1. (1) These Regulations may be cited as the Affordable Housing Act 2021 (Cost Rental Eligibility) Regulations 2023.

(2) These Regulations come into operation on 1 August 2023.

2. The Affordable Housing Act 2021 (Cost Rental Letting and Eligibility) Regulations 2021 (S. I. No. 755 of 2021) are amended by substituting for Regulation 10 the following:

“10. The combined annual total net income of all prospective members of the household in a cost rental dwelling which is located —

(a) in the administrative area of Dublin City Council, Dún Laoghaire-Rathdown County Council, Fingal County Council or South Dublin County Council, shall not exceed €66,000, or

(b) elsewhere in the State, shall not exceed €59,000,

in order to be considered as a qualified household.”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations set the combined net annual income levels for all prospective members of the household in a cost rental dwelling, where the dwelling is situated in—

(a) Dublin City Council, Dún Laoghaire-Rathdown County Council, Fingal County Council or South Dublin County Council, an income not exceeding €66,000, or

(b) elsewhere in the State, an income not exceeding €59,000.
