Confidentiality of proceedings | ||
32. (1) A person shall not disclose any information obtained— | ||
(a) by a party to an appeal before an adjudicator to which section 31 (2) does not apply, and | ||
(b) as a result of such an appeal, | ||
to any person other than— | ||
(i) a party to the appeal, | ||
(ii) a legal representative of a party to the appeal, | ||
(iii) the adjudicator, | ||
(iv) a witness whose evidence is relevant to the appeal, to the extent such disclosure is necessary for the witness to give such evidence, or | ||
(v) where an appeal is taken under section 34 , or judicial review proceedings are taken in relation to a screening decision or a matter before an adjudicator, to— | ||
(I) the court, | ||
(II) a party to the appeal or proceedings, | ||
(III) a legal representative of a party to the appeal or proceedings, or | ||
(IV) a witness whose evidence is relevant to the appeal or proceedings, to the extent such disclosure is necessary for the witness to give such evidence. | ||
(2) A person who contravenes subsection (1) shall be guilty of an offence. |
