Qualification of obligation to issue screening notice in exceptional circumstances

15. (1) Where the Minister is satisfied, in relation to a non-notified transaction, that there are reasonable grounds for believing that it would be manifestly contrary to the security or public order of the State to—

(a) issue a screening notice to a party to a transaction, or

(b) include in the screening notice one or more of the statements referred to in section 14 (2),

the Minister may elect not to do so.

(2) Where the Minister elects not to issue a screening notice in relation to a transaction in accordance with this section, a period that is stated in this Act to be reckoned from the date on which a screening notice is issued shall, in relation to the transaction, be reckoned from the date on which the Minister commences a review of the transaction under this Act.
