S.I. No. 2/2022 - Avian Influenza (Temporary Measures) (No. 7) Regulations 2021 (Amendment) Regulations 2022


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 7th January, 2022.

The Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on him by section 36 of the Animal Health and Welfare Act 2013 (No. 15 of 2013) and for the purpose of giving full effect to Commission Regulation (EU) 2020/ 687 of 17 December 20191 in so far as that Regulation applies to avian influenza, makes the following regulations:

1. These Regulations may be cited as the Avian Influenza (Temporary Measures) (No.7) Regulations 2021 (Amendment) Regulations 2022 and, subject to Regulation 3, come into operation on 7 January 2022.

2. The Avian Influenza (Temporary Measures) (No.7) Regulations 2021 are amended –

(a) in Regulation 2, by the deletion of “protection zone 2, protection zone 4 and”,

(b) in Regulation 3 (a)by the deletion of “partly within protection zone 2, protection zone 4 or” and “protection zone 3,” and “protection zone 2, protection zone 4 or”,

(c) by the substitution for Regulation 3 of-

“3. Land or premises-

(a) that lies partly within protection zone 5 is deemed to lie wholly within that protection zone, and

(b) subject to paragraph (a), that lies partly within surveillance zone 5 and partly outside that surveillance zone is deemed to lie wholly within that surveillance zone.”,

(d) in Part 3 of Schedule 1 by the deletion of “(apart from the townlands situate in protection zone 4)” in both places where it occurs, and

(e) by the deletion of Part 2 and Part 4 of Schedule 2.

3. From 8 January 2022, the Avian Influenza (Temporary Measures) (No.7) Regulations 2021 are amended by the substitution for the matter in Part 1 of Schedule 1 of the matter in the Schedule to these Regulations.

The Electoral Divisions of Clontibret, Cremartin, Annayalla Carrickaslane Castleblayney Rural, Castleblaney Urban Church Hill, the townlands of Dunmaurice, Terrygreghan, Clogher, Drumguillew Lower, Shane, Drumguillew Upper, Cabragh and Drumgarra in the Electoral Division of Greagh, the townlands of Lagan, and Cargagh in the Electoral Division of Laragh, the townlands of Drumgolat, Feddans, Drumbeg, Listinny, Shanmullagh, Annaseeragh, Ennis, Mullans, Clerran, Tirmacmoe, Moy Etra, Moy Otra, Corcaskea, Bryanlitter, Tulllybuck, Lisaginny situate in the Electoral Division of Castleshane, the townland of Ballycronin situate in the Electoral Division of Rathwallace, the townlands of Corfad, Corlongford, Cussaboy, Corraviller, Derrylusk, Cornahoe, Cornanagh, Tiromedan, Cordolough, Coohey, Corfinlough, Derryhallagh, Lennan, Drumroosk, Cargaghramer, Drumlongfield, Cornanure situate in the Electoral Division of Tullycorbet, all in county Monaghan.

These Regulations provide for the removal of certain temporary measures formerly in place to combat the threat posed by avian influenza; most restrictions remain in place for the present.
