S.I. No. 778/2021 - Courts and Court Officers Act 1995 (Section 9(2)) Order 2021


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 10th December, 2021.

WHEREAS section 9 (2) (inserted by section 8 of the Civil Law (Miscellaneous Provisions) Act 2021 (No. 14 of 2021)) of the Courts and Court Officers Act 1995 (No. 31 of 1995) (as adapted by the Justice and Equality (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 452 of 2020 )) provides that the Government may, in accordance with that section, by order provide that the number of ordinary judges of the High Court otherwise provided for under any enactment for the time being in force may be exceeded by one;

WHEREAS the Minister for Justice has, after consultation with the Minister for Public Expenditure and Reform, made a request under the said section 9(2);

AND WHEREAS the Government are of the opinion that, having regard to the volume of business to be transacted in the High Court and to the need to ensure the efficient transaction of business in that Court, it is necessary in the interests of the administration of justice to provide that the number of ordinary judges of the High Court otherwise provided for under any enactment for the time being in force may be exceeded by one;

NOW the Government, in exercise of the powers conferred on them by section 9 (2) (inserted by section 8 of the Civil Law (Miscellaneous Provisions) Act 2021 (No. 14 of 2021)) of the Courts and Court Officers Act 1995 (No. 31 of 1995), hereby order as follows:

1. This Order may be cited as the Courts and Court Officers Act 1995 (Section 9(2)) Order 2021.

2. The number of ordinary judges of the High Court otherwise provided for under any enactment for the time being in force may be exceeded by one.
