S.I. No. 532/2021 - Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2021

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 26th October, 2021.

I, EAMON RYAN, Minister for the Environment, Climate and Communications, in exercise of the powers conferred on me by section 39 (amended by Regulation 22 of the European Communities (Internal Market in Electricity) Regulations 2005 ( S.I. No. 60 of 2005 )) of the Electricity Regulation Act 1999 (No. 23 of 1999) and the Communications, Energy and Geological Survey of Ireland (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 300 of 2002 ) (as adapted by the Communications, Climate Action and Environment (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 373 of 2020 )), following consultation with the Minister for Housing, Local Government and Heritage (as adapted by the Housing, Planning and Local Government (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 408 of 2020 )), and having given a draft of this Order to the persons upon whom the obligation is to be imposed, hereby order as follows:

Citation

1. This Order may be cited as the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2021.

Definition

2. In this Order, “Principal Order” means the Electricity Regulation Act 1999 (Public Service Obligations) Order 2002 ( S.I. No. 217 of 2002 ).

Amendment of Article 2 of Principal Order

3. Article 2 of the Principal Order is amended –

(a) by the substitution of the Schedule set out in Schedule 1 to this Order for Schedule 1 (amended by Article 3(b) of the Order of 2019),

(b) by the substitution of the Schedule set out in Schedule 2 to this Order for Schedule 1 (amended by Article 3(c) of the Order of 2020).

(c) by the substitution of the Schedule set out in Schedule 3 to this Order for Schedule 2 (amended by Article 3(c) of the Order of 2020).

(d) in paragraph (1) (amended by Article 3 of the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2018 ( S.I. No. 403 of 2018 )), by inserting the following definitions:

“ ‘RESS’ means the Renewable Electricity Support Scheme, as referred to in State Aid Decision SA.54683 (2020/N) – Ireland;

‘RESS Contracts Notification’ means the correspondence referred to in paragraph (1) of the European Commission document entitled ‘C(2020) 4795 final’ dated 20 July 2020 relating to a notification to that Commission (Reference no. SA.54683 (2020/N) – Ireland) pursuant to Article 108(3) of the Treaty on the Functioning of the European Union;”, and

(e) by inserting the following paragraph after paragraph (3C):

“(3D) (a) For the purposes of Articles 8(1)(bf) and 10(1)(a), ‘additional costs’ includes costs incurred by a supplier in complying with its obligations under Article 6E either before or after the coming into operation of this paragraph and which are not otherwise recovered.

(b) Nothing in subparagraph (a) shall entitle a supplier to recover additional costs unless those costs are in accordance with the method for determination of costs provided for in the RESS Contracts Notification, as applied by the Commission in any relevant decision on the calculation of RESS costs, and this Order.”.

Period of public service obligations

4. Article 4 (amended by Article 3 of the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2018 ( S.I. No. 403 of 2018 )) of the Principal Order is amended by inserting the following paragraph after paragraph (1G):

“(1H) The period of the public service obligations to be imposed pursuant to Article 6E shall commence in respect of a RESS generator listed in column 2 of Schedule 6 -

(a) in the case of a generator not registered in the Single Electricity Market pursuant to Regulation 5 of the Single Electricity Market Regulations, on the date on which the supplier purchases output which is exported for the purposes of distribution or transmission from the plant of the generator, and

(b) in the case of a generator registered in the Single Electricity Market pursuant to Regulation 5 of the Single Electricity Market Regulations and a supplier registered as the intermediary for that generator, on the date on which the supplier purchases output which is exported for the purposes of transmission or distribution from the plant of the generator.”.

Public service obligation for RESS contracts

5. The Principal Order is amended by inserting the following Article after Article 6D:

“Public service obligation for RESS contracts

6E. (1) There shall be imposed by the Commission on each supplier specified in column (3) of Schedule 6 a requirement that, pursuant to the RESS PPA for the project specified in column (2) at that reference number, such supplier have available to it and purchase the electricity generated by the generator specified at that reference number in column (4), which electricity shall be generated from the energy source specified at that reference number in column (5) and which electricity is the subject of the RESS PPA concerned.

(2) The obligation imposed pursuant to paragraph (1) shall not, as respects a supplier specified in column (3), require that supplier to have available to it and purchase the electricity concerned after the termination of the RESS PPA concerned by the generator specified in column (4) at that reference number in accordance with the terms of that agreement which shall be in conformity with the RESS Contracts Notification.

(3) A reference in this Article to a column is a reference to a column of the Table in Schedule 6.”.

Amendment of Article 7 of Principal Order

6. Article 7 of the Principal Order is amended –

(a) in paragraph (3) (amended by Article 8 of the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2008 ( S.I. No. 284 of 2008 )), by substituting “paragraphs (4) and (5)” for “paragraph (4)”, and

(b) by inserting the following paragraph after paragraph (4):

“(5) In respect of the obligation imposed by Article 6E, the PSO Levy imposed shall terminate not later than the end of the period specified in the terms and conditions of the relevant RESS competition.”.

Amendment of Article 8 of Principal Order

7. Article 8 of the Principal Order is amended –

(a) in paragraph (1) (amended by Article 9 of the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2008 ( S.I. No. 284 of 2008 )), by inserting the following subparagraph after subparagraph (be):

“(bf) the additional costs of suppliers in the period concerned in complying with the obligation imposed on it by Article 6E, as determined by the Commission pursuant to Article 9;”, and

(b) in paragraph (2)(a) (amended by Article 9 of the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2008 ( S.I. No. 284 of 2008 )), by substituting “the REFIT Contracts Notification or the RESS Contracts Notification” for “the REFIT Contracts Notification”.

Amendment of Article 9 of Principal Order

8. Article 9 of the Principal Order is amended –

(a) by inserting the following paragraph after paragraph 2I:

“(2J) In respect of the obligation imposed by Article 6E in any single levy period, the PSO Levy shall be determined by the Commission on the basis of the estimates made by it of the amounts required to meet the costs and expenses specified in Article (1)(bf) and any over-recovery or under-recovery of those amounts in that single levy period shall be taken into account in setting the amount of the PSO Levy in respect of the levy period commencing 2 levy periods later.”, and

(b) in paragraph (3) (amended by Article 2 of the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2012 ( S.I. No. 438 of 2012 )), by inserting the following subparagraph after subparagraph (ab):

“(ac) (i) At least 5 months prior to the commencement of a levy period each relevant supplier shall provide the Commission with an estimate of the additional costs, calculated in accordance with the method specified for determination of such costs in the RESS Contracts Notification as applied by the Commission in any relevant decision on the calculation of RESS costs that such supplier estimates it will incur in the next levy period in complying with its obligations under this Order in respect of each RESS PPA to which it is a party.

(ii) A relevant supplier may only receive payment from the PSO Levy fund in respect of each RESS PPA to which it is a party in any given levy period when the specific RESS project is specified in Schedule 6 and when the relevant supplier—

(I) has been included in both the PSO levy decision taken by the Commission for the specific levy period, and

(II) has commenced generation or, as determined by the Commission, is in a position to commence generating.”.

Amendment of Article 10 of Principal Order

9. Article 10(1) (amended by Article 11 of the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2008 ( S.I. No. 284 of 2008 )) is amended by inserting the following paragraph after paragraph (ab):

“(ac) each supplier on whom an obligation is imposed by Article 6E shall provide details to the Commission of the actual additional costs incurred by that supplier in complying with the obligation imposed on it by that Article, and”.

Insertion of Schedule 6 to Principal Order

10. The Principal Order is amended by inserting the Schedule, set out in the Schedule to this Order, after Schedule 5.

SCHEDULE 1

Article 3

“Schedule 1

In this Schedule –

‘biomass’ means the biodegradable fraction of products, waste and residues from biological origin from agriculture (including vegetal and animal substances), forestry and related industries including fisheries and aquaculture, as well as the biodegradable fraction of industrial and municipal waste;

‘LFG’ means landfill gas;

‘CHP’ means combined heat and power;

‘small scale wind project’ means any wind-powered electricity generating plant with a maximum export capacity of or less than 5 MW which is connected directly to the electricity network and metered independently of any other electricity generating plant;

‘large scale wind project’ means an onshore wind project with a maximum export capacity greater than 5 MW which is connected directly to the electricity network and metered independently of any other electricity generating plant;

‘hydro project’ means any hydro-powered electricity generating plant with a maximum export capacity of or less than 5 MW which is connected directly to the electricity network and metered independently of any other electricity generating plant.

In this Schedule -

‘AD’ means anaerobic digestion;

‘anaerobic digestion’ means the process by which biomass material is broken down by micro-organisms under anaerobic conditions, and where the resulting biogas is used to generate electricity;

‘co-firing’ means the combustion of biomass, up to 30% of the stated electricity generation capacity of the plant in any single year, in one of the existing three peat fired power stations operational under state aid clearance;

‘cogeneration’ means the simultaneous generation in one process of thermal energy and electrical or mechanical energy, or electrical and mechanical energy;

‘HECHP’ means high efficiency cogeneration which complies with criteria specified in Annex II of Directive 2012/27/EC1.

EXPLANATORY NOTE

(center note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order modifies and updates elements of Statutory Instrument 217 of 2002, the principal order, dealing with the public service obligation on electricity consumers. This Order specifically updates the principal order in respect of the addition of the Renewable Electricity Support Scheme and the provision of a statutory basis for the Commission for the Regulation for Utilities (CRU) to make payments to suppliers included on the PSO Order once generation has commenced in accordance with the terms of the relevant Renewable Electricity Support Scheme competition. The order updates the principal order in respect of renewable energy projects in the Renewable Energy Feed in Tariff Schemes and the Renewable Electricity Support Scheme. This order does not update the renewable energy projects in the AER V1 Scheme which remain as listed in the Statutory Instrument Order 600 of 2016.
