S.I. No. 678/2020 - Personal Insolvency Act 2012 (Prescribed Fees) (Amendment) Regulations 2020

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 5th January, 2021.

The Insolvency Service of Ireland, in exercise of the powers conferred on it by section 3 and section 20 (as amended by section 40 of the Courts and Civil Law (Miscellaneous Provisions) Act 2013 (No. 32 of 2013)) of the Personal Insolvency Act 2012 (No. 44 of 2012), and with the consent of the Minister for Justice (as adapted by the Justice and Equality (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 452 of 2020 )), hereby makes the following regulations:

1. (1) These Regulations may be cited as the Personal Insolvency Act 2012 (Prescribed Fees) (Amendment) Regulations 2020.

(2) These Regulations shall come into operation on 1 January 2021.

2. The Personal Insolvency Act 2012 (Prescribed Fees) Regulations 2015 ( S.I. No. 620 of 2015 ) (as amended by Regulation 2 of the Personal Insolvency Act 2012 (Prescribed Fees) (Amendment) Regulations 2017 ( S.I. No. 609 of 2017 )) are amended in Regulation 6 by substituting “31 December 2023” for “31 December 2020”.

The Minister for Justice consents to the making of the foregoing Regulations.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations amend Regulation 6 of the Personal Insolvency Act 2012 (Prescribed Fees) Regulations 2015 ( S.I. No. 620 of 2015 ) (the “2015 Regulations”) by substituting “31 December 2023” for “31 December 2020”. As a consequence of this substitution, the temporary waiver of fees as set out in Regulation 6 of the 2015 Regulations now applies to an application made under section 29(1), 59(1) and 93(1) of the Personal Insolvency Act 2012 where such application is made after the date of the coming into operation of the 2015 Regulations and on or before 31 December 2023.
