S.I. No. 417/2020 - Forestry (Licence Application and Submission Fees) Regulations 2020

I, Charlie McConalogue, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by sections 6 and 25 of the Forestry Act 2014 (No. 31 of 2014), hereby make the following regulations:

Citation and commencement

1. (1) These Regulations may be cited as the Forestry (Licence Application and Submission Fees) Regulations 2020.

(2) These Regulations come into operation on 7th October 2020.

Interpretation

2. In these Regulations—

“Act” means the Forestry Act 2014 (No. 31 of 2014);

“Forestry Regulations” means the Forestry Regulations 2017 ( S.I. No. 191 of 2017 );

“submission” means any communication received in accordance with section 10 (4) of the Forestry Regulations.

Charging of fees

3. (1) The following fees are prescribed pursuant to section 25 of the Act and shall be paid to the Minister in relation to—

(a) an application for a licence in respect of:

(i) afforestation, a fee of €20;

(ii) forest road works, a fee of €20;

(iii) aerial fertilisation, a fee of €20;

(iv) tree felling, a fee of €20, and

(b) a submission in respect of any one forestry licence application referred to in subparagraph (a), a fee of €20.

(c) the purchase of a document referred to in Regulation 10(3) of the Forestry Regulations-

(i) for the search and retrieval of a record, a fee of €20 per hour for the time spent, by each person concerned, in carrying out the search and retrieval efficiently,

(ii) for the copying of the requested record, a fee of €0.04 for each sheet that forms part of the record,

(iii) fees under (i) and (ii) apply regardless whether requests for records are made in hard copy or electronic format,

(d) the purchase of a document referred to in Regulation 21(3) of the Forestry Regulations-

(i) for the search and retrieval of a record, a fee of €20 per hour for the time spent, by each person concerned, in carrying out the search and retrieval efficiently,

(ii) for the copying of the requested record, a fee of €0.04 for each sheet that forms part of the record,

(iii) fees under (i) and (ii) apply regardless whether requests for records are made in hard copy or electronic format.

(2) A fee received by the Minister under this Regulation shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Public Expenditure and Reform shall direct.
