S.I. No. 55/2020 - European Union (Natural Mineral Waters, Spring Waters and Other Waters in Bottles or Containers) (Amendment) Regulations 2020

I, SIMON HARRIS, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Council Directive 2013/51/EURATOM of 22 October 20131 , hereby make the following regulations:

1. (1) These Regulations may be cited as the European Union (Natural Mineral Waters, Spring Waters and Other Waters in Bottles or Containers) (Amendment) Regulations 2020.

(2) The Principal Regulations and these Regulations may be cited together as the European Union (Natural Mineral Waters, Spring Waters and Other Waters in Bottles or Containers) Regulations 2016 and 2020.

2. In these Regulations “Principal Regulations” means the European Union (Natural Mineral Waters, Spring Waters and Other Waters in Bottles or Containers) Regulations 2016 ( S.I. No. 282 of 2016 ).

3. Regulation 17 of the Principal Regulations is amended by substituting for paragraph (11) the following paragraph:

“(11) (a) The Authority shall define the sampling frequencies for radioactive substances in other waters having regard to the volume of water produced, as appropriate.

(b) The Authority, or an official agency, shall monitor for radioactive substances in other waters in accordance with the sampling frequencies defined by the Authority pursuant to subparagraph (a), in order to check whether the values of radioactive substances comply with the parametric values referred to in Regulation 16(1)(c) and (d).”.

EXPLANATORY NOTE

These Regulations give further effect to Council Directive 2013/51/EURATOM of 22 October 2013, in particular by requiring the Food Safety Authority of Ireland to define the sampling frequencies for other waters which apply in monitoring of such waters for radioactive substances.

These Regulations amend the European Union (Natural Mineral Waters, Spring Waters and Other Waters in Bottles or Containers) Regulations 2016.

These Regulations may be cited as the European Union (Natural Mineral Waters, Spring Waters and Other Waters in Bottles or Containers) (Amendment) Regulations 2020.
