Amendment of section 70 of Act of 2005

44. Section 70 of the Act of 2005 is amended—

(a) in subsection (1), by the substitution of “not being” for “other than”, and

(b) in subsection (3), by the insertion of “and direct how the costs of the application are to be borne” after “to do so”.
