S.I. No. 591/2019 - Social Welfare (Consolidated Contributions and Insurability) (Amendment) (No. 2) (Modified Insurance) Regulations 2019

I, REGINA DOHERTY, Minister for Employment Affairs and Social Protection, in exercise of the powers conferred on me by sections 4 (adapted by the Social and Family Affairs (Alteration of Name of Department and Title of Minister) Order 2017 ( S.I. No. 366 of 2017 )), 14 and 61G(2) (inserted by section 29 of the Parent’s Leave and Benefit Act 2019 (No. 35 of 2019)), of the Social Welfare Consolidation Act 2005 (No. 26 of 2005), with the consent of the Minister for Finance, given after consultation with the Minister for Public Expenditure and Reform, hereby make the following Regulations:

Citation and construction

1. (1) These Regulations may be cited as the Social Welfare (Consolidated Contributions and Insurability) (Amendment) (No. 2) (Modified Insurance)) Regulations 2019.

(2) These Regulations and the Social Welfare (Consolidated Contributions and Insurability Regulations) 1996 to 2019 shall be construed together as one and may be cited together as the Social Welfare (Consolidated Contributions and Insurability) Regulations 1996 to 2019.

Definition

2. In these Regulations, “Regulations of 2011” means the Social Welfare (Consolidated Contributions and Insurability) (Amendment) (Civil Partnership) Regulations 2011 ( S.I. No.602 of 2011 ).

Commencement

3. These Regulations come into operation on 1 November 2019.

Modifications of Insurance

4. The Social Welfare (Consolidated Contributions and Insurability) Regulations 1996 ( S.I. No. 312 of 1996 ) are amended –

(a) in article 81(2)(b) (amended by article 5 of the Regulations of 2011), by the insertion of “parent’s benefit,” after “carer’s benefit,”,

(b) in article 82(2)(b) (amended by article 5 of the Regulations of 2011), by the insertion of “parent’s benefit,” after “carer’s benefit,”,

(c) in article 83(2)(b) (amended by article 5 of the Regulations of 2011), by the insertion of “parent’s benefit,” after “carer’s benefit,”, and

(d) in article 83A(3)(c) (inserted by article 2 of the Social Welfare (Consolidated Contributions and Insurability) (Amendment) (No. 5) (Modifications of Social Insurance) Regulations 2014 ( S.I. No. 512 of 2014 )), by the insertion of “parent’s benefit,” after “carer’s benefit,”.

The Minister for Finance consents to the making of the foregoing Regulations.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The Parent’s Leave and Benefit Act 2019 amended the Social Welfare Consolidation Act 2005 to insert a new Chapter 11B which provides for a new social insurance scheme, Parent’s Benefit.

These Regulations, which come into effect from 1 November 2019, amend articles 81, 82, 83 and 83A of the Social Welfare (Consolidated Contributions and Insurability) Regulations 1996 ( S.I. No. 312 of 1996 ) to extend entitlement to Parent’s Benefit to Class B, C and D PRSI contributors.
