S.I. No. 413/2019 - European Union (Basic Safety Standards for Protection Against Dangers Arising from Medical Exposure to Ionising Radiation) (Amendment) (No. 2) Regulations 2019

I, SIMON HARRIS, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Council Directive 2013/59/EURATOM of 5 December 20131 , as affected by Corrigendum to Council Directive 2013/59/EURATOM of 17 March 20162 , insofar as it relates to medical exposures, hereby make the following regulations:

1. (1) These Regulations may be cited as the European Union (Basic Safety Standards for Protection Against Dangers Arising from Medical Exposure to Ionising Radiation) (Amendment) (No. 2) Regulations 2019.

(2) The Principal Regulations, the Regulations of 2019, and these Regulations may be cited together as the European Union (Basic Safety Standards for Protection Against Dangers Arising from Medical Exposure to Ionising Radiation) Regulations 2018 and 2019.

2. In these Regulations –

“Principal Regulations” means the European Union (Basic Safety Standards for Protection Against Dangers Arising from Medical Exposure to Ionising Radiation) Regulations 2018 ( S.I. No. 256 of 2018 ).

“Regulations of 2019” means the European Union (Basic Safety Standards for Protection Against Dangers Arising from Medical Exposure to Ionising Radiation) (Amendment) Regulations 2019 ( S.I. No. 332 of 2019 ).

3. Regulation 10 of the Principal Regulations (as amended by Regulation 3 of the 2019 Regulations) is amended by substituting for paragraph (4) the following:

“(4) Practical aspects of a medical radiological procedure may be delegated by—

(a) the undertaking, or

(b) the practitioner,

as appropriate, to one or more individuals—

(i) registered by the Dental Council,

(ii) registered by the Medical Council,

(iii) registered by the Nursing and Midwifery Board of Ireland,

(iv) whose name is entered in the register established and maintained by the Radiographers Registration Board pursuant to section 36 of the Health and Social Care Professionals Act 2005 , or

(v) recognised by the Minister under Regulation 19,

as appropriate, provided that such person has completed training in radiation safety prescribed or approved pursuant to Regulation 22(3) by the appropriate body.”.

These Regulations amend the European Union (Basic Safety Standards for Protection Against Dangers Arising from Medical Exposure to Ionising Radiation) Regulations 2018 to give further effect to Council Directive 2013/59/EURATOM of 5 December 2013. These Regulations may be cited as the European Union (Basic Safety Standards for Protection Against Dangers Arising from Medical Exposure to Ionising Radiation) (Amendment) (No. 2) Regulations 2019.
