S.I. No. 360/2019 - Sea-Fisheries (Common Fisheries Policy) (Bluefin Tuna) (Amendment) Regulations 2019

I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by Sections 3 , 14 and 15 of the Sea-Fisheries and Maritime Jurisdiction Act 2006 (No. 8 of 2006) and the Sea Fisheries, Foreshore and Dumping at Sea (Transfer of Departmental Administration and Ministerial Functions) Order 2007 ( S.I. No. 707 of 2007 ) (as adapted by the Agriculture, Fisheries and Food (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 455 of 2011 )), for the purpose of giving effect to Regulation (EU) 2019/833 of the European Parliament and of the Council of 20 May 20191 hereby make the following regulations:

1. These Regulations may be cited as the Sea-Fisheries (Common Fisheries Policy) (Bluefin Tuna) (Amendment) Regulations 2019.

2. The Sea-Fisheries (Common Fisheries Policy) (Bluefin Tuna) Regulations 2016 ( S.I. No. 680 of 2016 ) are amended:

(a) In Regulation 3(1) by the insertion after “14 September 2016” in the definition of “Bluefin Tuna Regulation” of the following: “as amended by Regulation (EU) 2019/833 of the European Parliament and of the Council of 20 May 2019”;

(b) In Regulation 3(2) by the addition of “as the case may be.” at the end of the Regulation;

(c) By substituting the following for Regulation 7: “A master shall ensure that by-catches of bluefin tuna are retained until the level of 5% of total catches is reached, and a master shall ensure the level of by-catches of bluefin tuna shall not exceed 5% of the total catches on board at the end of each fishing trip. By-catches are to be calculated by reference to the parameters set out in Article 16 of the Bluefin Tuna Regulation as amended by Regulation (EU) 2019/833 of the European Parliament and of the Council of 20 May 2019.”

EXPLANATORY NOTE

This instrument implements further measures for the protection of Bluefin Tuna (Thunnus Thynnus) adopted by the European Union as a contracting party to The International Commission for the Conservation of Atlantic Tunas. The multiannual recovery plan for bluefin tuna in the eastern Atlantic and Mediterranean is implemented by COUNCIL REGULATION (EC) No. 2016/1627 as amended by Regulation (EU) 2019/833 of the European Parliament and of the Council of 20 May 2019.
