S.I. No. 223/2018 - Public Sales of Greyhounds (Amendment) Regulations 2018

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 29th June, 2018.

Bord na gCon in exercise of the powers conferred on it by Sections 38 and 48 (13) of the Greyhound Industry Act 1958 (No. 12 of 1958) and also by subsection (3) of Section 5 of said Act hereby makes the following regulations, that is to say —

1. These regulations may be cited as the Public Sales of Greyhounds (Amendment) Regulations 2018.

2. The Public Sales of Greyhounds (Amendment) Regulations, 1987 ( S.I. No. 121 of 1987 ) are hereby revoked.

3. The Public Sales of Greyhounds Regulations 1966 ( S.I. No. 76 of 1966 ) are hereby amended as follows:

(1) by the substitution of the following Article for Article 7:

“7.The fee payable to the Board for the grant of a licence shall be €10 (ten euros) and for the renewal of a licence €5 (five euros).”

(2) by the deletion of Article 9(3).

(3) in Article 11,

(a) by the substitution of the following paragraph for paragraph (1):

“(1) Save as provided in sub article (2) of this Article, every greyhound offered for sale shall be required to run a trial on the day on which it is being offered for sale unless the Board or the attending stewards authorise otherwise.”

(b) by the substitution of the following paragraph for paragraph (2):

“(2) A greyhound which has not had at least one trial before date of sale shall not be allowed compete in a trial on that date.”

(c) by the substitution of the following paragraph for paragraph (7):

“(7) Unless prescribed by the Board or the attending stewards, in a trial run on date of sale, the greyhound with the lowest lot number in the sales catalogue shall start, where seeding permits, from the inside trap and so on”.

(d) by the substitution of the following paragraph for paragraph (8):

“(8) Unless prescribed by the Board or the attending stewards greyhounds shall be offered for sale in catalogue order. Where greyhounds are late for their allotted trials they may only be trialled at the conclusion of all other allotted trials.”

(4) by the deletion of Article 14 (2), (3) and (4).

(5) by the deletion of Article 16.

(6) in paragraph (1) of Article 17, by the substitution of the following sub-paragraph for sub-paragraph (e)

“(e) publish on the Board’s website, or in such manner as approved by the Board, the following information:

(i) a copy of the sales catalogue in advance of the sales

(ii) the results of sales trials

(iii) details of lots sold and unsold by auction

(iv) details of the sales price of greyhounds sold by auction.”

4. These regulations shall come into operation on the 1st day of July 2018.

These regulations, made by Bord na gCon, amend the conditions which will apply to sales including arrangements for trials, allocation of traps to include seeding requirements, the arrangements for offering catalogue lot numbers and the publication of information.
