S.I. No. 219/2018 - Nurses and Midwives (Register of Nurses and Midwives) Rules 2018


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 29th June, 2018.

The Nursing and Midwifery Board of Ireland, in exercise of the powers conferred on it by section 13 of the Nurses and Midwives Act 2011 (No. 41 of 2011), with the approval of the Minister for Health, hereby makes the following rules:-

Citation

1. These Rules may be cited as the Nurses and Midwives (Register of Nurses and Midwives) Rules 2018.

Commencement

2. These Rules come into operation on 25 June 2018.

Definitions

3. In these Rules—

“Act” means the Nurses and Midwives Act 2011 (No. 41 of 2011);

“registration number” means the personal identification number (PIN) attached to the registration of a nurse or midwife in the register of nurses and midwives.

Divisions of register of nurses and midwives

4. The register of nurses and midwives shall consist of the following divisions:

(a) nurses division;

(b) general nurses division;

(c) psychiatric nurses division;

(d) children’s nurses division;

(e) intellectual disability nurses division;

(f) public health nurses division;

(g) nurse tutors division;

(h) nurse prescribers division;

(i) advanced nurse practitioners division;

(j) midwives division;

(k) midwife tutors division;

(l) midwife prescribers division; and

(m) advanced midwife practitioners division.

Information to be contained in register of nurses and midwives

5. The register of nurses and midwives shall contain, in respect of each nurse or midwife registered, the following particulars:

(a) first name and surname, as appear on proof of identity provided when applying to be registered;

(b) if applicable, any other name by which the nurse or midwife is known;

(c) registration number;

(d) date and place of birth;

(e) nationality;

(f) gender;

(g) postal address for correspondence;

(h) email address for correspondence;

(i) contact telephone number(s);

(j) name of country in which nursing or midwifery qualification was obtained;

(k) title(s) of nursing or midwifery qualification(s);

(l) languages spoken;

(m) if applicable, place of work and position held;

(n) date on which first registered in register;

(o) date on which registration due for renewal;

(p) if applicable, that the nurse or midwife is temporarily registered for purpose of providing services in the State on a temporary and occasional basis under Part 4 of Regulations of 2017, and period of such temporary registration;

(q) division(s) of register of nurses and midwives in which registered and date(s) on which first registered in such division(s);

(r) any annotation under section 48(3) of the Act;

(s) any relevant medical disability declared under section 51(1) of Act;

(t) relevant conditions, if any, attached to registration;

(u) any findings of any disciplinary proceedings in relation to the nurse or midwife’s practice as a nurse or midwife;

(v) if applicable, details of current registrations as a nurse or midwife in other jurisdictions; and

(w) any further particulars the Board obtains from him or her in the exercise of its regulatory functions.

Revocation

6. The Nurses and Midwives Rules 2013 ( S.I. No. 435 of 2013 ) are revoked.

Transitional provisions

7. (1) Midwife tutors who, on the commencement of these Rules, are registered in the nurse tutors division of the register of nurses and midwives and who are not registered in the nurses division of the register of nurses and midwives shall be registered in the midwife tutors division and their registration in the nurse tutors division shall be removed.

(2) Midwife prescribers who, on the commencement of these Rules, are registered in the nurse prescribers division of the register of nurses and midwives and who are not registered in the nurses division of the register of nurses and midwives shall be registered in the midwife prescribers division and their registration in the nurse prescribers division shall be removed.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

These Rules provide for the divisions of the register of nurses and midwives maintained by the Nursing and Midwifery Board of Ireland under the Nurses and Midwives Act 2011 , and the particulars to be entered in such register.

These Rules may be cited as the Nurses and Midwives (Register of Nurses and Midwives) Rules 2018.

These Rules come into operation on 25 June 2018.
