S.I. No. 57/2018 - Local Authorities (Traffic Wardens) Act 1975 (Fixed Charge Offences) (Amendment) Regulations 2018

I, SHANE ROSS, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 3 of the Local Authorities (Traffic Wardens) Act 1975 (No. 14 of 1975) (as adapted by the Transport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 141 of 2011 )), and after consultation with the Minister for Justice and Equality (as adapted by the Justice and Law Reform (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 138 of 2011 )), hereby make the following regulations:

1. These Regulations may be cited as the Local Authorities (Traffic Wardens) Act 1975 (Fixed Charge Offences) (Amendment) Regulations 2018.

2. These Regulations come into operation on 1 March 2018.

3. In these Regulations “Principal Regulations” means the Local Authorities (Traffic Wardens) Act 1975 (Fixed Charge Offences) Regulations 2006 ( S.I. No. 136 of 2006 ).

4. The Principal Regulations are amended by the substitution of the following paragraph for paragraph (a) of Regulation 5:

“(a)€150, in respect of the offence under section 35(5) of the Act of 1994 for a contravention of the provision of the Regulations mentioned in Schedule 1,”.

5. Schedule 1 to the Principal Regulations is amended by the substitution of “€150 fixed charge” for “€80 fixed charge”.
