S.I. No. 300/2017 - Road Traffic Act 2010 (Section 44(3)) (Prescribed Notice) Regulations 2017.


Notice of the making of this Statutory Instrument was published in

I, SHANE ROSS, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 5 of the Road Traffic Act 1961 (No. 24 of 1961), the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No 298 of 2002 ) and section 44(3) (inserted by section 27 of the Road Traffic Act 2016 (No. 21 of 2016)) of the Road Traffic Act 2010 (No. 25 of 2010) (as adapted by the Transport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 141 of 2011 )), hereby make the following regulations:

1. These Regulations may be cited as the Road Traffic Act 2010 (Section 44(3)) (Prescribed Notice) Regulations 2017.

2. The form of notice set out in the Schedule is the form of notice prescribed for the purposes of section 44(3) (inserted by section 27 of the Road Traffic Act 2016 (No. 21 of 2016)) of the Road Traffic Act 2010 (No. 25 of 2010).

Payment of Fixed Charge

1. In respect of the offence alleged in this notice you may, not later than 7 days before the date specified in the summons served with this notice on which the charge is to be heard by the Court on ……………(insert date), pay a fixed charge of €…………….. (insert amount), or if you do not pay that fixed charge during that period, you must attend Court on the date directed.

2. A payment of a fixed charge under this notice must be accompanied by all of this notice[, fully completed,]* [if payment is made in person or by post, or by quoting the reference number mentioned on it, if payment is allowed otherwise below,]* and in the manner stated below.

3. If payment of the fixed charge in a manner as specified in paragraph 2 above is made, no proceedings in respect of the alleged offence will continue and you need not attend the Court on the day specified in the summons served with this notice.

4. 1 (1) If you pay in accordance with this notice the correct amount of the fixed charge (insert number)............ penalty points will be endorsed on the entry in the driving licence or learner permit record relating to you.

4. Ní mór an fógra seo ina iomláine [agus é comhlánaithe go hiomlán]* a bheith in éineacht le híocaíocht ar mhuirear seasta faoin bhfógra seo [i gcás go ndéantar íocaíocht i bpearsa nó sa phost, nó tríd an uimhir thagartha air a lua, i gcás go gceadaítear íocaíocht a dhéanamh ar bhealach eile thíos]*, agus ar an modh a luaitear thíos.
