S.I. No. 151/2017 - Road Traffic Act 2010 (Sections 15 and 17) (Prescribed Forms) (Amendment) Regulations 2017.


Notice of the making of this Statutory Instrument was published in

I, SHANE ROSS, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 5 of the Road Traffic Act 1961 (No. 24 of 1961) and section 17 of the Road Traffic Act 2010 (No. 25 of 2010) (as adapted by the Transport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 141 of 2011 )), hereby make the following regulations:

1. (1) These Regulations may be cited as the Road Traffic Act 2010 (Sections 15 and 17) (Prescribed Forms) (Amendment) Regulations 2017.

(2) These Regulations come into operation on 13 April 2017.

2. The Road Traffic Act 2010 (Sections 15 and 17) (Prescribed Forms) Regulations 2011 ( S.I. No. 540 of 2011 ) are amended—

(a) by inserting after Regulation 5 the following:

“6.The form set out in Part 3 of Schedule 2 is the prescribed form of certificate for the purposes of section 17 of the Act of 2010 to certify the concentration of a drug or drugs.”

and

(b) in Schedule 2, after Part 2, by inserting the text set out in the Schedule.

Certificate issued by the Medical Bureau of Road Safety under section 17 of the Road Traffic Act, 2010 , certifying a concentration of a drug or drugs in blood.

Deimhniú arna eisiúint ag an Lia-Bhiúró um Shábháilteacht ar Bhóithre faoi alt 17 den Acht um Thrácht ar Bhóithre, 2010, á dheimhniú go bhfuil cion druga nó drugaí i bhfuil.

Particulars relating to specimen received for analysis, as shown on the form completed by designated doctor or designated nurse:-

The Regulations prescribe the certificate, both in English and Irish, to be issued by the Medical Bureau of Road Safety under section 17 of the Road Traffic Act, 2010 in respect of a concentration of a drug or drugs in a specimen.
