I, FRANCES FITZGERALD, T.D., Minister for Justice and Equality in exercise of the powers conferred on me by section 27 (2)(b) of the Civil Legal Aid Act 1995 (No. 32 of 1995) and the Equality and Law Reform (Transfer of Departmental Administration and Ministerial Functions) Order 1997 ( S.I. No. 297 of 1997 ) (as adapted by the Justice and Law Reform (Alteration of Name of Department and Title of Minister) Order 2011 and with the consent of the Minister for Public Expenditure and Reform hereby order as follows:

1. (1) This Order may be cited as the Civil Legal Aid (International Protection Appeals Tribunal) Order 2017.

(2) This Order comes into operation on 8th March, 2017.

2. The International Protection Appeals Tribunal is prescribed for the purposes of section 27 (2)(b) of the Civil Legal Aid Act 1995 (No. 32 of 1995).

3. The Civil Legal Aid (Refugee Appeals Tribunal) Order 2005 (SI 730 of 2005) is revoked.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

This Order, which comes into effect from the 8th day of March, 2017, replaces the Civil Legal Aid (Refugee Appeals Tribunal) Order 2005 which is hereby revoked.

This Order prescribes the International Protection Appeals Tribunal for the purposes of Section 27 (2(b)) of the Civil Legal Aid Act, 1995 (No. 32 of 1999) as a body at whose proceedings legal aid may be provided by the Legal Aid Board.
