S.I. No. 31/2017 - Planning and Development (Housing) and Residential Tenancies Act 2016 (Commencement of Certain Provisions) (No. 2) Order 2017.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd February, 2017.

I, SIMON COVENEY, Minister for Housing, Planning, Community and Local Government, in exercise of the powers conferred on me by section 1 (3) of the Planning and Development (Housing) and Residential Tenancies Act 2016 (No. 17 of 2016), hereby order as follows:

1. This Order may be cited as the Planning and Development (Housing) and Residential Tenancies Act 2016 (Commencement of Certain Provisions) (No. 2) Order 2017.

2. The day after the making of this Order is appointed as the day on which—

(a) section 19 of the Planning and Development (Housing) and Residential Tenancies Act 2016 (No. 17 of 2016) comes into operation in so far as it relates to the requirements of section 144 of the Planning and Development Act 2000 (No. 30 of 2000) in determining and giving notice of fees payable to the Board in respect of matters relating to proposed strategic housing developments, and

(b) so much of section 3 of the Planning and Development (Housing) and Residential Tenancies Act 2016 comes into operation as may be necessary for the purpose of enabling paragraph (a) to have effect.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

This Order brings section 19 of the Planning and Development (Housing) and Residential Tenancies Act 2016 into operation on 2 February 2017, for the purpose of enabling An Bord Pleanála to fulfil the requirements of section 144 of the Planning and Development Act 2000 in relation to setting the fees payable to the Board in respect of applications for, and other matters relating to, proposed strategic housing developments. The Order also brings section 3 of the Act into operation on the same date to the extent required to enable the partial commencement of section 19 to have effect.
