I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Implementing Directive (EU) 2016/11 of 5 January 20161 and Commission Implementing Directive (EU) 2016/317 of 3 March 20162 , hereby make the following regulations: | ||
1. These Regulations may be cited as the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2016. | ||
2. The European Communities (Seed of Oil Plants and Fibre Plants) Regulations 2003 ( S.I. No. 280 of 2003 ) are amended by substituting in— | ||
(a) Regulation 2(1) for the definition of “EC Directive” (as amended by the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2005 ( S.I. No. 917 of 2005 )) the following: | ||
“‘Directive’ means Council Directive 2002/57/EC of 13 June 20023 (as amended by Council Directive 2002/68/EC of 19 July 20024 , Commission Directive 2003/45/EC of 28 May 20035 , Council Directive 2003/61/EC of 18 June 20036 , Council Directive 2004/117/EC of 22 December 20047 , Commission Directive 2009/74/EC of 26 June 20098 , Commission Implementing Directive (EU) 2016/11 of 5 January 2016 and Commission Implementing Directive (EU) 2016/317 of 3 March 2016) subject to Commission Regulation (EC) No 217/2006 of 8 February 20069 as it relates to oil and fibre plants;”, | ||
(b) Regulation 6(1) (as amended by the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2005) “Directive” for “EC Directive”, and | ||
(c) Regulation 21 (inserted by the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2005) “Directive” for “EC Directive” in each place that it occurs. | ||

EXPLANATORY NOTE | ||
(This note is not part of the instrument and does not purport to be a legal interpretation.) | ||
These Regulations amend Council Directive 2002/57/EC on the marketing of seed of oil and fibre plants by adjusting the minimum varietal purity of the seed. | ||
These Regulations also amend Annexes IV and V to Council Directive 2002/57/EC on the marketing of seed of oil plants and fibre plants. | ||
