S.I. No. 503/2016 - Social Housing Allocation (Amendment) Regulations 2016.

I, SIMON COVENEY, Minister for Housing, Planning, Community and Local Government, in exercise of the powers conferred on me by sections 3 and 22 (4) of the Housing (Miscellaneous Provisions) Act 2009 (No. 22 of 2009), as adapted by the Environment, Community and Local Government (Alteration of Name of Department and Title of Minister) Order 2016 (S.I. 394 of 2016), hereby make the following regulations:

1. These Regulations may be cited as the Social Housing Allocation (Amendment) Regulations 2016.

2. These Regulations come into operation on 30 September 2016.

3. The Social Housing Allocation Regulations 2011 (S.I. 198 of 2011) are amended—

(a) in Regulation 5 by substituting the following paragraph for paragraph (2):

“(2) The manner of allocating dwellings referred to in paragraph (1) shall incorporate the choice-based letting procedure set out in Regulations 6 to 11 not later than 31 December 2016.”, and

(b) in Regulation 7(4)(c) by substituting “paragraph 5(a)” for “Regulation 5(a)”.

EXPLANATORY NOTE

These Regulations amend the Social Housing Allocation Regulations 2011 (S.I. 198 of 2011) to provide that a housing authority must, when setting out the manner in which it shall allocate dwellings under its allocation scheme, incorporate the choice-based letting procedure set down in S.I. 198 of 2011. Housing authorities are required to amend their allocation schemes by 31 December 2016 to provide for the choice–based letting procedure.

The Regulations also rectify a typographical error in Regulation 7 of S.I. 198 of 2011.
