I, Michael Creed, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) for the purpose of giving full effect to Regulation (EU) No 1305/2013 of the European Parliament and of the Council of 17 December 20131 (as amended by Regulation (EU) No 1310/2013 of the European Parliament and of the Council of 17 December 20132 , Commission Delegated Regulation (EU) No 994/2014 of 13 May 20143 , Commission Delegated Regulation (EU) No 1378/2014 of 17 October 20144 , Commission Delegated Regulation (EU) 2015/791 of 27 April 20155 , Commission Delegated Regulation (EU) 2016/142 of 2 December 20156 ), Commission Delegated Regulation (EU) No 807/2014 of 11 March 20147 , Commission Implementing Regulation (EU) No 808/2014 of 17 July 20148 , Regulation (EU) No 1306/2013 of the European Parliament and of the Council of 17 December 20139 (as amended by Regulation (EU) No 1310/2013 of the European Parliament and of the Council of 17 December 2013), Commission Delegated Regulation (EU) No 640/2014 of 11 March 201410 , Commission Implementing Regulation (EU) No 809/2014 of 17 July 201411 , Regulation (EU) No 1307/2013 of the European Parliament and of the Council of 17 December 201312 (as amended by Regulation (EU) No 1310/2013 of the European Parliament and of the Council of 17 December 2013, Commission Delegated Regulation (EU) No 639/2014 of 11 March 201413 , Commission Delegated Regulation (EU) No 994/2014 of 13 May 2014, Commission Delegated Regulation (EU) No 1001/2014 of 18 July 201414 , Commission Delegated Regulation (EU) No 1378/2014 of 17 October 2014, Commission Delegated Regulation (EU) 2015/851 of 27 March 201515 , Commission Delegated Regulation (EU) 2016/142 of 2 December 2015), Commission Delegated Regulation (EU) No 639/2014 of 11 March 2014, Commission Implementing Regulation (EU) No 641/2014 of 16 June 201416 hereby make the following regulations: | ||
1. These Regulations may be cited as the European Communities (Direct support schemes) Offences and Control (Amendment) Regulations 2016. | ||
2. The European Communities (Direct support schemes) Offences and Control Regulations 2016 ( S.I. No. 169 of 2016 ) are amended- | ||
(a) by substituting in Regulation 2 for the definition of “Authorised Officer” the following— | ||
“’authorised officer’ means- | ||
(a) a person appointed under Regulation 5, and | ||
(b) a person who, immediately before the making of these Regulations was an authorised officer (within the meaning of the European Communities (Direct support schemes) Offences and Control Regulations 2012 ( S.I. No. 115 of 2012 ));”, and | ||
(b) by inserting the following after Regulation 9- | ||
“10.(1) The European Communities (Direct support schemes) Offences and Control Regulations 2012 ( S.I. No. 115 of 2012 ) are revoked. | ||
(2) An authorisation or notice granted or issued under the Regulations referred to in paragraph 1 that is in force immediately before the revocation, continues in force and may be dealt with as if granted or issued under these Regulations.”. | ||
