S.I. No. 455/2016 - Carriage of Livestock by Sea (Amendment) Regulations 2016.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 30th August, 2016.

I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in the exercise of the powers conferred on me by section 36 of the Animal Health and Welfare Act 2013 (No. 15 of 2013), hereby make the following Regulations:

1. These Regulations may be cited as the Carriage of Livestock by Sea (Amendment) Regulations 2016 and are deemed to have come into operation on 4 July 2016.

2. The Carriage of Livestock by Sea Regulations 2016 are amended-

(a) by the insertion, after Regulation 4(8), of—

“(9)“In the case of a vessel subject to an application mentioned in Regulation 27(2) (inserted by Regulation 2(b) of the Carriage of Livestock by Sea (Amendment) Regulation 2016), it is sufficient compliance with paragraph (4) if a valid classification certificate issued by a classification society which is a member of the International Association of Classification Societies is extant in respect of the vessel.”,

(10) Paragraph (9) ceases to have effect on 1 January 2017.”, and

(b) by the insertion, after Regulation 26, of—

“27.(1) An approval granted under an Order revoked by Regulation 26 that is in force immediately before the commencement of these Regulations remains in force and may be dealt with as if granted under Regulation 4.

(2) An application for an approval under an Order revoked by Regulation 26 that has not been determined before the making of these Regulations may be dealt with as if made under Regulation 4.”.
