I, LEO VARADKAR, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Article 85c of Directive 2001/83/EC of the European Parliament and of the Council of 6 November 20011 , as amended by Article 1(20) of Directive 2011/62/EU of the European Parliament and of the Council of 8 June 20112 , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Amendment of the Pharmacy Act 2007) Regulations 2015.

2. Section 7(1) (as amended by s. 32(a) of the Health (Pricing and Supply of Medical Goods) Act 2013 (No. 14 of 2013)) of the Pharmacy Act 2007 (No. 20 of 2007) is amended—

(a) in paragraph (e), by substituting “Health (Pricing and Supply of Medical Goods) Act 2013, and” for “Health (Pricing and Supply of Medical Goods) Act 2013.”, and

(b) by inserting after paragraph (e) the following paragraph:

“(f) to establish and maintain, in accordance with regulation 19A (inserted by regulation 7 of the Medicinal Products (Prescription and Control of Supply) (Amendment) Regulations 2015 ( S.I. No. 87 of 2015 )) of the Medicinal Products (Prescription and Control of Supply) Regulations 2003 ( S.I. No. 540 of 2003 ), the ISS supply list of persons entitled to supply non-prescription medicinal products at a distance to the public by means of information society services.”.

EXPLANATORY NOTE

These Regulations amend the Pharmacy Act 2007 to make it a principal function of the Pharmaceutical Society of Ireland to establish and maintain the ISS supply list of persons entitled to supply non-prescription medicinal products at a distance to the public by means of information society services.

These Regulations amend the Pharmacy Act 2007 .

These Regulations may be cited as the European Union (Amendment of the Pharmacy Act 2007 ) Regulations 2015.
