S.I. No. 31/2015 - European Communities (Carriage of Dangerous Goods by Road and Use of Transportable Pressure Equipment) (Amendment) Regulations 2015.


Notice of the making of this Statutory Instrument was published in

I, RICHARD BRUTON, Minister for Jobs, Enterprise and Innovation, in the exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2008/68/EC of the European Parliament and of the Council of 24 September 20081 (insofar as that Directive relates to the transport of dangerous goods by road) hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Carriage of Dangerous Goods by Road and Use of Transportable Pressure Equipment) (Amendment) Regulations 2015.

2. The European Communities (Carriage of Dangerous Goods by Road and Use of Transportable Pressure Equipment) Regulations 2011 and 2013 and these Regulations may be cited together as the European Communities (Carriage of Dangerous Goods by Road and Use of Transportable Pressure Equipment) Regulations 2011 to 2015.

3. The European Communities (Carriage of Dangerous Goods by Road and Use of Transportable Pressure Equipment) Regulations 2011 ( S.I. No. 349 of 2011 ) are amended—

(a) in Regulation 2(1), by the substitution of the following definition for the definition of “INAB”:

“ ‘INAB’ means the Irish National Accreditation Board;”, and

(b) in Regulation 42—

(i) in paragraph (1)—

(I) by the substitution of “The fees charged by the Authority in consideration of the performance by INAB of its functions” for “The fees charged by the INAB”, and

(II) by the substitution of “in accordance with section 47 (amended by section 33 of the Industrial Development (Forfás Dissolution) Act 2014 ) of the Safety, Health and Welfare at Work Act 2005 , are payable to the Authority in accordance with the terms and conditions of the invoice issued by the Authority” for “shall be so charged in accordance with the INAB Schedule of Fees which is published annually”,

and

(ii) by the deletion of paragraphs (2) and (3).

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations amend the European Communities (Carriage of Dangerous Goods by Road and Use of Transportable Pressure Equipment) Regulations 2011 to 2013 to take account of the integration of the Irish National Accreditation Board (formerly a Committee of Forfás), into the Health and Safety Authority (HSA), as a Committee thereof, with effect from 31st July 2014, in advance of the dissolution of Forfás on 1st August 2014.

They provide that any fees for ADR related services by INAB will be charged by, and payable to, the HSA.
