S.I. No. 560/2014 - Road Traffic Act 2006 (Commencement) (Penalty Point - Speed Limitation Devices) Order 2014.

I, PASCHAL DONOHOE , Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 23 (2) of the Road Traffic Act 2006 (No. 23 of 2006) and section 26 (2) of the Road Traffic Act 2002 (No. 12 of 2002) (as adapted by the Transport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 141 of 2011 )), hereby order as follows:

1. This Order may be cited as the Road Traffic Act 2006 (Commencement) (Penalty Point — Speed Limitation Devices) Order 2014.

2. The day fixed as the day on which—

(a) section 16 (2)(e) (in so far as it relates to the insertion of Part 6 into the First Schedule to the Road Traffic Act 2002 (No. 12 of 2002) of the Road Traffic Act 2006 (No. 23 of 2006), and

(b) Part 6 (inserted by the said section 16 (2)(e)) of the First Schedule to the Road Traffic Act 2002 (No. 12 of 2002),

come into operation is 8th December 2014.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

This order commences the insertion of a new Part (No. 6) into the First Schedule of the Road Traffic Act 2002 . This Part 6 makes the contravention of Regulation 4, 5 or 6 of the European Communities (Installation and Use of Speed Limitation devices in Motor Vehicles) Regulation 2005 ( S.I. No. 831 of 2005 ), that is, using a vehicle not equipped with a speed limitation device or using a vehicle equipped with a speed limitation device not complying with the requirements specified in the Regulations, a penalty point offence. This offence carries an endorsement of 2 penalty points on the offender’s driver licence on payment of a Fixed Charge Notice, or 4 penalty points on conviction in court.
