I, LEO VARADKAR, Minister for Transport, in exercise of the power conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Directive 2013/60/EU of 27 November 20131 , amending Directive 2002/24/EC of the European Parliament and of the Council2 in so far as it relates to the entry into service of two or three-wheel motor vehicles, hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Two and Three Wheel Motor Vehicle Entry into Service) (Amendment) Regulations 2014.

2. Regulation 2(1) of the European Communities (Two and Three Wheel Motor Vehicle Entry into Service) Regulations 2005 ( S.I. No. 412 of 2005 ) is amended by substituting for the definition of “Council Directive” the following definition:

“‘Council Directive’ means Directive 2002/24/EC of the European Parliament and of the Council of 18 March 20022, as amended by Commission Directive 2003/77/EC of 11 August 2003, Act concerning the conditions of accession of the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic and the adjustments to the Treaties on which the European Union is founded3 , Commission Directive 2005/30/EC of 22 April 20054 , Council Directive 2006/96/EC of 20 November 2006, Commission Directive 2006/120/EC of 27 November 20065 , Regulation (EC) No. 1137/2008 of the European Parliament and of the Council of 22 October 20086 , Council Directive 2013/15/EU of 13 May 20137 and Commission Directive 2013/60/EU of 27 November 20138 .”

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation.)

The European Communities (Two and Three Wheel Motor Vehicle Entry into Service) Regulations 2005 ( S.I. No. 412 of 2005 ) gave effect to Directive 2002/24/EC (the Framework Directive) and to each of the separate Directives that individually regulate many components, systems and separate technical units, in so far as those Directives relate to the registration and entry into service of two or three wheel motor vehicles. The reference to Directive 2002/24/EC in the 2005 Regulations is now updated in order to take account of Commission Directive 2013/60/EU, in so far as that Directive relates to the entry into service of two or three-wheel motor vehicles.

These Regulations may be cited as the European Communities (Two and Three Wheel Motor Vehicle Entry into Service) (Amendment) Regulations 2014.
