S.I. No. 6/2014 - Civil Liability Act 1961 (Section 49) Order 2014.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 17th January, 2014.

WHEREAS I, ALAN SHATTER, Minister for Justice and Equality, pursuant to section 49 (1A) of the Civil Liability Act 1961 (No. 41 of 1961), am satisfied that the monetary amount for the time being standing specified in paragraph (b) of section 49 (1) of the Civil Liability Act 1961 should, having regard to the changes in value of money generally in the State since the monetary amount was so specified, be varied;

AND WHEREAS I consider that the amount specified in Article 2 is appropriate for the purposes of paragraph (b) of the said section 49(1);

NOW I, ALAN SHATTER, Minister for Justice and Equality, in exercise of the powers conferred on me by section 49 (1A) of the Civil Liability Act 1961 (No. 41 of 1961) (adapted by the Justice and Law Reform (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 138 of 2011 )), hereby order as follows:

1. This Order may be cited as the Civil Liability Act 1961 (Section 49) Order 2014.

2. The amount of €35,000 is specified for the purposes of paragraph (b) of section 49 (1) of the Civil Liability Act 1961 (No. 41 of 1961).

EXPLANATORY NOTE

This Order increases to €35,000 the maximum amount of damages that can be awarded to the dependants of a deceased person for mental distress in fatal personal injuries actions. This sum is to be shared among the dependants.
