S.I. No. 151/2013 - Statistics (Business Accounts Surveys) Order 2013.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 10th May, 2013.

I, ENDA KENNY, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) hereby order as follows:

1. (1) This Order may be cited as the Statistics (Business Accounts Surveys) Order 2013.

(2) This Order shall come into operation on 1 April 2013.

2. In this Order—

“Act” means the Statistics Act 1993 (No. 21 of 1993);

“Office” means Central Statistics Office;

“surveys” has the meaning given to it in Regulation 4(c).

3. (1) This Order applies to undertakings that are classified for statistical purposes under Sections B to S of NACE Rev. 2 (set out in Annex 1 to Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 20061 ).

(2) This Order does not apply in respect of information required of undertakings pursuant to the European Communities (Statistics) (Business Accounts Surveys) Regulations 2006 ( S.I. No. 247 of 2006 ).

4. Information required to be provided by this Order, the general nature of which is specified in the Schedule—

(a) is prescribed as information required to be provided for the purposes of surveys of undertakings to which this Order applies by means of the forms and questionnaires referred to in Article 5(a),

(b) shall be provided within the period of time specified by the Director General, and

(c) shall be provided in surveys (the first of which shall be in April 2013, or as soon as possible thereafter, relating to the period from July 2013 to September 2013) to be undertaken by the Office as nearly as possible at intervals of 3 months during the period from 1 April 2013 to 31 December 2017, in relation to the economic activities of the undertaking concerned in respect of the period to which the relevant survey undertaken in accordance with this Order applies.

5. An undertaking required by this Order to provide information to the Office shall provide such information—

(a) by the completion of forms and questionnaires prepared by the Director General in accordance with section 23 of the Act, and

(b) where directions under section 26 of the Act have been given to the undertaking, in accordance with those directions.

6. An undertaking required by this Order to provide information to the Office shall be deemed to comply with that requirement where, with the consent of the Director General, the information is provided by electronic means in a format or manner approved by the Director General.

7. The Statistics (Business Accounts Surveys) Order 2010 ( S.I. No. 349 of 2010 ) is revoked.

SCHEDULE

Regulation 4

1. Particulars of persons employed by the undertaking (for undertakings which are classified for statistical purposes under NACE Sections B to S).

2. Particulars of stock and work in progress of the undertakings (for undertakings which are classified for statistical purposes under NACE Sections B to S).

3. Particulars of moneys owned to the undertaking and moneys owned by the undertakings (for undertakings which are classified for statistical purposes under NACE Sections B to S).

4. Particulars of types of activities carried out by the undertakings (for undertakings which are classified for statistical purposes under NACE Sections B to S).

5. Particulars of capital assets (for undertakings which are classified for statistical purposes under NACE Sections B to S).
