S.I. No. 136/2012 - Children Act 2001 (Designation of Remand Centres) Order 2012.


Notice of the making of this Statutory Instrument was published in

I, FRANCES FITZGERALD T.D., Minister for Children and Youth Affairs, in exercise of the powers conferred on me by subsections (1) to (11) of section 88 (inserted by section 135 of the Criminal Justice Act 2006 (No. 26 of 2006) and adapted by the Remand Centres and Children Detention Schools (Transfer of Departmental Administration and Ministerial Functions) Order 2011 ( S.I. No. 668 of 2011 )) of the Children Act 2001 (No. 24 of 2001), hereby order as follows:

1. This Order may be cited as the Children Act 2001 (Designation of Remand Centres) Order 2012.

2. This Order comes into operation on 1 May 2012.

3. The following places are designated as remand centres under subsection (4) of section 88 (inserted by section 135 of the Criminal Justice Act 2006 (No. 26 of 2006)) of the Children Act 2001 (No. 24 of 2001):

(a) Trinity House School, Lusk, in the county of Dublin;

(b) Oberstown Boys’ School, Lusk, in the county of Dublin; and

(c) Oberstown Girls’ School, Lusk, in the county of Dublin.

4. The sex and age of children who may be remanded to the remand centres designated by Article 3 shall be the following, namely—

(a) in the case of Trinity House School, boys who, on the date of the court decision to remand in custody, are aged not less than 10 years old and less than 17 years old,

(b) in the case of Oberstown Boys’ School, boys who, on the date of the court decision to remand in custody, are aged not less than 10 years old and less than 17 years old, and

(c) in the case of Oberstown Girls’ School, girls who, on the date of the court decision to remand in custody, are aged not less than 10 years old and less than 18 years old.

The effect of this Order is that Trinity House School, Oberstown Boys’ School and Oberstown Girls’ School are designated as remand centres. The order also specifies the sex and age of children who may be remanded to the remand centres concerned at any time.
