S.I. No. 30/2012 - Patents, Trade Marks and Designs (Fees) (Amendment) Rules 2012.


Notice of the making of this Statutory Instrument was published in

I, SEÁN SHERLOCK, Minister of State at the Department of Jobs, Enterprise and Innovation, in exercise of the powers conferred on me by sections 81 , 82 and 86 of the Trade Marks Act 1996 (No. 6 of 1996), sections 29 , 37 (6), 99 and 114 of the Patents Act 1992 (No. 1 of 1992) and the Enterprise, Trade and Innovation (Delegation of Ministerial Functions) (No. 4) Order 2011 ( S.I. No. 241 of 2011 ) (as adapted by the Enterprise, Trade and Innovation (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 245 of 2011 )), and in relation to the said section 82 and the said section 99, with the sanction of the Minister for Public Expenditure and Reform, hereby make the following rules:

1. (1) These Rules may be cited as the Patents, Trade Marks and Designs (Fees) (Amendment) Rules 2012.

(2) These Rules come into operation on 1 February 2012.

2. In these Rules “Principal Rules” means the Patents, Trade Marks and Designs (Fees) Rules 2001 ( S.I. No. 482 of 2001 ).

3. (1) Schedule 1 to the Principal Rules is amended—

(a) by substituting the following text for the text in columns (1), (2) and (3) of reference number 6:

(b) by substituting “125.00” for “76.00” in column (3) opposite the mention in column (1) of reference number 15,

(c) by substituting “60.00” for “25.00” in column (3) opposite the mention in column (1) of reference number 41, and

(d) by deleting the text in columns (1), (2) and (3) of reference number 53.

(2) Schedule 2 to the Principal Rules is amended—

(a) by substituting the following text for the text in columns (1), (2) and (3) of reference number 2:

To sit a written examination in Irish patent law and practice pursuant to a requirement under Rule 6(2).

On application for a review of marks obtained in the written examination in Irish patent law and practice.

To undergo a test in any subject, other than a written examination in Irish patent law and practice, pursuant to a requirement under Rule 6(2).

(c) by substituting “250.00” for “125.00” in column (3) opposite the mention in column (1) of reference number 4.

(3) Schedule 3 to the Principal Rules is amended—

(a) by substituting “50.00” for “250.00” in column (3) opposite the mention in column (1) of reference number 33,

(b) by inserting the following text in columns (1), (2) and (3) after reference number 33:
