S.I. No. 8/2012 - Diseases of Animals Act 1966 (Registration of Horse Premises) Order 2012.

I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by sections 3 and 13 of the Diseases of Animals Act 1966 (No. 6 of 1966) (as adapted by the Agriculture, Fisheries and Food (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 455 of 2011 )), hereby order as follows:

1. This Order may be cited as the Diseases of Animals Act 1966 (Registration of Horse Premises) Order 2012 and comes into operation on 1 May 2012.

2. In this Order—

“premises” includes land (with or without buildings), a vehicle, ship or other vessel, aircraft, railway wagon or other means of transport or any container used in transport;

"horse" includes ass and all other equines.

3. (1) The Minister shall cause to be established and maintained a register of premises to be known as the “Register of Horse Premises” for premises where a horse is kept.

(2) The owner or person in charge of premises where a horse is kept shall apply to have the premises entered on the Register of Horse Premises.

(3) An application for entry onto the Register of Horse Premises shall be in a form and contain such information as the Minister may determine.

(4) A person shall not keep a horse, unless details of the premises where the horse is kept are entered on the Register of Horse Premises.

(5) The owner or person in charge of a premises entered in the Register of Horse Premises shall maintain such records of the movement of a horse to and from the premises as the Minister may from time to time require.

(6) The owner or person in charge of a premises entered in the Register of Horse Premises shall furnish such information to the Minister as and when and in a form that the Minister may determine.

(7) The owner or person in charge of a premises entered in the Register of Horse Premises shall inform the Minister if he or she ceases to use the premises as a place where a horse is kept and the Minister shall amend the register accordingly.
