S.I. No. 35/2011 - Road Traffic (Licensing of Drivers) (Amendment) Regulations 2011.

I, PAT CAREY, Minister for Transport, in exercise of the powers conferred on me by section 42 of the Road Traffic Act 1961 (No. 24 of 1961), the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 305 of 2002 )), hereby make the following Regulations:

1. (1) These Regulations may be cited as the Road Traffic (Licensing of Drivers) (Amendment) Regulations 2011.

(2) These Regulations come into operation on 1 February 2011.

2. The Road Traffic (Licensing of Drivers) Regulations 2006 ( S.I. No. 537 of 2006 ) are amended by substituting for paragraph (1) of Regulation 25, as substituted by the Road Traffic (Licensing of Drivers) (Amendment) Regulations 2009 ( S.I. No. 130 of 2009 ), the following:

“(1) The fee to be paid to the issuing authority on application for a certificate of competency is—

(a)€120, where the application relates to vehicles of category EC1, EC, ED1 or ED, and subparagraph (c) does not apply to the application,

(b)€120, where the application relates to vehicles of category C1, C, D1 or D, and subparagraph (c) does not apply to the application,

(c) nil, where the application relates to vehicles in Category C1, C, D1, D, EC1, EC, ED1 or ED and the applicant satisfies the issuing authority that he or she is unemployed and has been unemployed for a continuous period of not less than 12 months immediately preceding the date of application and is registered with Forás Áiseanna Saothair (FÁS), and

(d)€85, in any other case.”.

These Regulations increase the fees chargeable by the issuing authority for the issue of a certificate of competency.
