S.I. No. 206/2010 - Statistics (Balance of Payments and Financial Accounts) Order 2010.

I, BRIAN COWEN, Taoiseach, in exercise of the powers conferred on me by sections 4 and 25(1) of the Statistics Act 1993 (No. 21 of 1993) and for the purpose of giving further effect to—

(a) Council Regulation (EC) No. 2223/96 of 25 June 1996 1 ,

(b) Council Regulation (EC) No. 2533/98 of 23 November 1998 2 ,

(c) Council Regulation (EC, Euratom) No. 1287/2003 of 15 July 2003 3 , and

(d) Regulation (EC) No. 184/2005 of the European Parliament and of the Council of 12 January 2005 4 ,

hereby order as follows:

1. This Order may be cited as the Statistics (Balance of Payments and Financial Accounts) Order 2010.

2. In this Order—

“non-resident” means a person who is not a resident;

“particulars” includes information relating to a state, a part of a state, a geographical region or a territory;

“person” includes an undertaking;

“resident” means—

(a) a person residing in the State,

(b) a person conducting a business within the State, whether or not the person has a registered or other trading office in the State in respect of that business, or

(c) in respect of a business conducted outside the State by a person in the State, the person conducting that business.

3. This Order applies to a person—

(a) engaged in,

(b) acting on behalf of another person engaged in, or

(c) who collects information from a person specified in paragraph (a) or (b) in relation to,

any or all of the transactions specified in Part 1 of the Schedule.

4. A person or undertaking to which this Order applies shall provide the Central Statistics Office with the information specified in Part 2 of the Schedule.

5. Information required to be provided by this Order, the general nature of which is specified in Part 2 of the Schedule—

(a) is prescribed as information required for the purposes of surveys of persons to whom this Order applies, and

(b) shall be provided on a monthly, quarterly, half-yearly or annual basis, as specified by the Director General.

6. (1) Subject to paragraph (2), a person required by virtue of this Order to provide information shall provide such information to the Director General of the Central Statistics Office by the completion of forms and questionnaires prepared by the Director General in accordance with section 23 of the Statistics Act 1993 (No. 21 of 1993).

(2) A person required by virtue of this Order to furnish information shall be deemed to comply with that obligation where, with the consent of the Director General, the information is furnished by electronic means, provided that the Director General approves the format or manner in which the information is provided.

SCHEDULE

Part 1

1. Provision of goods, services or financial instruments to non-residents.

2. Receipt of goods, services or financial instruments from non-residents.

3. Acquisition or disposal of a financial claim on non-residents.

4. Incurrence or redemption of a financial liability to non-residents.

5. Payment of income to non-residents.

6. Receipt of income from non-residents.

Part 2

1. Particulars of shareholdings in or ownership of the undertaking.

2. Particulars of shareholdings in or ownership of any undertaking.

3. Particulars relating to the value of goods, services and financial instruments provided by a person to residents or non-residents, or both, in the period concerned.

4. Particulars relating to the value of goods, services and financial instruments received by a person from residents or non-residents, or both, in the period concerned.

5. Particulars relating to the value of transactions in respect of financial claims on residents or non-residents, or both, engaged in by a person.

6. Particulars relating to the value of transactions in respect of financial liabilities to residents or non-residents, or both, engaged in by a person.

7. Particulars relating to the value of financial claims on residents or non-residents, or both, held by a person.

8. Particulars relating to the value of financial liabilities to residents or non-residents, or both, held by a person.

9. Particulars relating to the value of amounts received or receivable by a person from residents or non-residents, or both.

10. Particulars relating to the value of amounts paid or payable by a person to residents or non-residents, or both.

11. The address of the registered office and other locations where the business is conducted.

12. The business, trading or other names by which the person is known.

13. The description of the business in which the person is engaged.
