EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

The European Communities (Marine Equipment) Regulations 2009 ( S.I. No. 259 of 2009 ) are amended to transpose Commission Directive 2009/26/EC. This Directive is the latest amendment of Council Directive 96/98/EC on marine equipment. The purpose of the 1996 Directive (and of the amendments to it over the years) is to enhance safety at sea and to prevent marine pollution through the uniform application of the relevant international instruments relating to certain marine equipment. These regulations give effect to the latest amendment to replace the text in Annex A.1. to the 1996 Directive — this annex sets out a list of marine equipment for which detailed testing standards already exist in international instruments. The regulations also provide that transitional arrangements apply until 6 April 2012 for certain marine equipment that was manufactured before 6 April 2010.
