I, JOHN GORMLEY, Minister for the Environment, Heritage and Local Government, in exercise of the powers conferred on me by sections 4 and 142 of the Local Government Act 2001 (No. 37 of 2001) (as adapted by the Environment and Local Government (Alteration of Name of Department and Title of Minister) Order 2003 ( S.I. No. 233 of 2003 )) and with the consent of the Minister for Finance, hereby make the following Regulations:

1. These Regulations may be cited as the Local Government Act 2001 (Section 142) Regulations 2010.

2. The maximum amount which a local authority may provide for the payment of allowances for expenses incurred by its members in connection with attendance at conferences, seminars, training or other events to which subsection (5) of section 142 of the Local Government Act 2001 (No. 37 of 2001) applies, for 2010 and for each subsequent year is—

(a) in the case of a local authority, being a county council or a city council, €4,700 multiplied by the number of members of the relevant authority,

(b) in the case of a local authority, being a local authority referred to in Part I of the Schedule, €3,000 multiplied by the number of members of the relevant authority,

(c) in the case of a local authority, being a local authority referred to in Part II of the Schedule, €2,000 multiplied by the number of members of the relevant authority,

and

(d) in the case of a local authority, being a local authority referred to in Part III of the Schedule, €1,000 multiplied by the number of members of the relevant authority.

3. Nothing in these Regulations shall prevent a local authority from providing in its budget for the payment of an amount less than that specified in Regulation 2.

SCHEDULE

Local Authorities referred to in Regulation 2

Part I

The councils of the boroughs of Clonmel, Drogheda, Kilkenny, Sligo and Wexford, and the councils of the towns of Athlone, Bray, Dundalk, Ennis and Tralee.

Part II

The councils of the towns of—

(a) Arklow, Athy, Ballina, Ballinasloe, Birr, Buncrana, Bundoran, Carlow, Carrickmacross, Carrick-on-Suir, Cashel, Castlebar, Castleblayney, Cavan, Clonakilty, Clones, Cobh, Dungarvan, Enniscorthy, Fermoy, Kells, Killarney, Kilrush, Kinsale, Letterkenny, Listowel, Longford, Macroom, Mallow, Midleton, Monaghan, Naas, Navan, Nenagh, New Ross, Skibbereen, Templemore, Thurles, Tipperary, Trim, Tullamore, Westport, Wicklow and Youghal.

(b) Balbriggan, Droichead Nua, Greystones, Leixlip, Mullingar, Portlaoise and Shannon.

Part III

The councils of the towns of Ardee, Ballybay, Ballyshannon, Bandon, Bantry, Belturbet, Boyle, Cootehill, Edenderry, Gorey, Granard, Kilkee, Lismore, Loughrea, Mountmellick, Muinebheag, Passage West, Tramore and Tuam.

The Minister for Finance consents to the making of the foregoing Regulations.

These Regulations limit the amount that a local authority can provide for the payment of allowances for expenses in respect of attendance by elected members at conferences, seminars, training and other events for 2010 and for each subsequent year.
