S.I. No. 72/2009 - Health Insurance Act 1994 (Registration) (Amendment) Regulations 2009


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 10th March, 2009.

I, MARY HARNEY, Minister for Health and Children, in exercise of the powers conferred on me by sections 3 and 14 of the Health Insurance Act 1994 (No. 16 of 1994), hereby make the following regulations:

1. (1) These Regulations may be cited as the Health Insurance Act 1994 (Registration) (Amendment) Regulations 2009.

(2) These Regulations and the Health Insurance Act 1994 (Registration) Regulations 1996 ( S.I. No. 80 of 1996 ) may be cited together as the Health Insurance Act 1994 (Registration) Regulations 1996 and 2009 and shall be read together as one.

(3) These Regulations shall come into operation on 16th day of March, 2009.

2. The Health Insurance Act 1994 (Registration) Regulations 1996 are amended by the substitution of the following Regulation for Regulation 7:

“7. A restricted membership undertaking shall be registered if it complies with the following conditions:

(a) in the case of an undertaking providing cover solely for relevant health services, if it is registered as a friendly society pursuant to the Friendly Societies Acts 1896 to 1977 and complies with the provisions of the Health Insurance Acts 1994 to 2007; or

(b) if it was lawfully carrying on health insurance business in the State on the 30th day of June 1994 and complies with the provisions of the Health Insurance Acts 1994 to 2007.
