Oireachtas (Ministerial and Parliamentary Offices) (Secretarial Facilities)(No. 2) Regulations 2007

The Houses of the Oireachtas Commission, in exercise of the powers conferred on it by:

-      section 10(4) (inserted by section 1 of the Oireachtas (Ministerial and Parliamentary Offices) (Amendment) Act 2001 (No. 30 of 2001) and transferred by section 4(3)(a) of the Houses of the Oireachtas Commission Act 2003 (No.28 of 2003)) of the Ministerial and Parliamentary Offices Act 1938 and

-      section 2(1)(c) (inserted by section 3 of the Oireachtas (Miscellaneous Provisions) and Ministerial and Parliamentary Offices (Amendment) Act 1996 (No.39 of 1996) and transferred by section 4(3)(b) of the Houses of the Oireachtas Commission Act 2003 (No.28 of 2003)) of the Oireachtas (Allowances to Members) Act 1962 (No.32 of 1962),

hereby makes the following regulations:

1.         (1)       These Regulations may be cited as the Oireachtas (Ministerial and Parliamentary Offices) (Secretarial Facilities) (No. 2) Regulations 2007.

(2)       These regulations are deemed to have come into operation on 15 February 2007.

2.         In these Regulations:

-         “Commission” means the Houses of the Oireachtas Commission established under the Houses of the Oireachtas Commission Acts 2003 and 2006.

-         “independent member” means a Member of either House of the Oireachtas who is not a member of a Qualifying Party;

-         “qualifying party” has the meaning assigned to it under Section 10 (14) of the Ministerial and Parliamentary Offices Act 1938, as inserted by section 1 of the Oireachtas (Ministerial and Parliamentary Offices) (Amendment) Act 2001;

-         “Technical Group” means the Group established on 9th October, 2002, pursuant to Standing Order 114(1)(b) of the Standing Orders of Dáil Éireann relative to Public Business.

3.         Subject to regulation 4, each qualifying party and the Technical Group is entitled to a budget for outsourced graphic design facilities based on the aggregate sum of €398.23 per member of that party or of the Technical Group: provided that each independent member who is not a member of the Technical Group shall be entitled to a budget of €398.23 per member.

4.         Payment of the graphic design outsourcing budget shall be on the basis of expenditure incurred on or before 30 April 2007 or the dissolution of the Dáil whichever is the earlier and vouched in accordance with the form set out in the Schedule: provided that no payment in respect of such expenditure shall be made after 31 July 2007.

SCHEDULE

I, the undersigned, certify that

(1) the following graphic design expenses were incurred solely for [delete as appropriate] -

(i)  the purposes of facilitating my parliamentary duties, in accordance with section 2(1)(c) of the Oireachtas (Allowances to Members) Act 1962

(ii)  the purposes of facilitating the parliamentary activities of the elected member(s) of the ____________ party in accordance with section 10(4) of the Ministerial and Parliamentary Offices Act 1938,

(2) this graphic design work could not be provided by in-house graphic design facilities provided by the Houses of the Oireachtas Commission,

(3) the external services procured represent value for money, and

(4) the expenditure was incurred on or after 15 February 2007 and prior to 30 April 2007 or the dissolution of the Dáil, whichever is the earlier.

Accordingly, I hereby present these expenses to be paid out of ongoing expenditure of the Commission
