S.I. No. 404/2004 - Road Traffic (Traffic and Parking) (Amendment) Regulations 2004


I, SÉAMUS BRENNAN, Minister for Transport, in exercise of the powers conferred on me by sections 3 and 35 (as amended by section 62 of the Transport (Railway Infrastructure) Act 2001 (No. 55 of 2001)) of the Road Traffic Act 1994 (No. 7 of 1994) and the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 305 of 2002 )), hereby make the following regulations:

1.  (1)  These Regulations may be cited as the Road Traffic (Traffic and Parking) (Amendment) Regulations 2004.

(2)  The Road Traffic (Traffic and Parking) Regulations 1997 to 2003 and these Regulations may be cited together as the Road Traffic (Traffic and Parking) Regulations 1997 to 2004.

2.  Article 29(1) of the Road Traffic (Traffic and Parking) Regulations 1997 ( S.I. No. 182 of 1997 ) is amended by substituting “junction between one or more roads and a light railway” for “junction”.

3.  The Road Traffic (Traffic and Parking) Amendment Regulations 2003 ( S.I. No. 98 of 2003 ) are amended—

(a) in Article 9—

(i) by substituting for sub-article (2) the following:

“(2) Subject to sub-article (3), a person shall not enter a tram-only street or part thereof in the city of Dublin specified in the Schedule with a vehicle other than a light rail vehicle.”, and

(ii) by inserting after sub-article (3) the following:

“(4) Where traffic sign number RUS 011 is accompanied by an information plate placed below the sign indicating the period of operation of a tram-only street, sub-article (2) applies during the period indicated only.

(5) In this Article, “access” means entry or exit by a vehicle (other than a light rail vehicle) to or from a road or premises adjacent to or accessible only from a tram-only street without stopping or parking the vehicle on the street.”, and

(b) by substituting for the Schedule the following:

“SCHEDULE

Tram-only streets

1.   Steevens Lane.

2.   Sean Heuston Bridge.

3.   Arran Quay Terrace between its junction with Burges Lane and its junction with Smithfield.

4.   Chancery Street between its junction with Church Street and its junction with Greek Street.

5.   Abbey Street Upper between its junction with Liffey Street Lower and its junction with Jervis Street.

6.   Abbey Street Upper between its junction with Jervis Street and its junction with Wolfe Tone Street.

7.   Peter Place for a distance of 32 metres south of its junction with Adelaide Road.

8.   Benburb Street from its junction with Temple Street West to its junction with Liffey Street West.”.

EXPLANATORY NOTE.

These Regulations amend the Road Traffic (Traffic and Parking) Regulations 1997 to 2003 in relation to the application of certain traffic and parking regulations in connection with the on-street running of light rail vehicles and designate specified streets (or part thereof) in the city of Dublin as tram-only streets.
