S.I. No. 185/2004 - European Communities (Feedingstuffs) (Methods of Sampling and Analysis) (Amendment) Regulations 2004


I, JOE WALSH, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Directive 2002/70/EC of 26 July 20021 and Commission Directive 2003/126/EC of 23 December 20032 , hereby make the following regulations—

1.  (1)  These Regulations may be cited as the European Communities (Feedingstuffs) (Methods of Sampling and Analysis) (Amendment) Regulations 2004.

(2)  The European Communities (Feedingstuffs) (Methods of Sampling and Analysis) Regulations 1999 to 2000 and these Regulations may be cited collectively as the European Communities (Feedingstuffs) (Methods of Sampling and Analysis) Regulations 1999 to 2004.

2.  Regulation 2(1) of the European Communities (Feedingstuffs) (Methods of Sampling and Analysis) Regulations, 1999 are amended by substituting the definition of “prescribed method of analysis” for the following:

“ ‘prescribed method of analysis’ means a method of analysis which is established as a Community method of analysis for the official control of feedingstuffs in accordance with:—

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations amend the European Communities (Feedingstuffs) (Methods of Sampling and Analysis) Regulations 1999 to 2000, so as to give effect to Commission Directive 2002/70/EC of 26 July 2002 and Commission Directive 2003/126/EC of the 23 December 2003 which establishes Community methods of analysis for the determination of levels of dioxins and dioxin-like PCBs in feedingstuffs and methods of analysis for the determination of constituents of animal origin in feedingstuffs respectively. The Regulations should be read in conjunction with the Commission Directives.
