S.I. No. 78/2004 - Misuse of Drugs Act, 1977 (Controlled Drugs) (Declaration No. 4) Order, 2004


THE GOVERNMENT, in exercise of the powers conferred on them by section 2 (2) of the Misuse of Drugs Act, 1977 (No. 12 of 1977), hereby makes the following Order:

1. This Order may be cited as the Misuse of Drugs Act, 1977 (Controlled Drugs) (Declaration No. 4) Order, 2004.

2. This Order shall come into operation on the 1st day of March, 2004.

3. Each of the substances, products and preparations specified in the Schedule to this Order is hereby declared to be a controlled drug for the purposes of the Misuse of Drugs Act, 1977 (No. 12 of 1977).

SCHEDULE

1. The stereoisomeric forms of the following substances, not being cathine, namely:

N-Acetylanthranilic acid

Ephedrine

Ergometrine

Ergotamine

Isosafrole (cis isomer)

Isosafrole (trans isomer)

Lysergic acid

3,4-Methylenedioxyphenylpropan-2-one

Norephedrine (Phenylpropanolamine)

1-Phenyl-2-propanone

Piperonal

Pseudoephedrine

Safrole.

2. Any salt of a substance specified in paragraph 1 of this Schedule.

3. Any preparation or other product containing any proportion of a substance or product specified in paragraph 1 or 2 of this Schedule.

EXPLANATORY NOTE.

The purpose of this Order is to declare certain substances, products and preparations to be controlled drugs for the purposes of the Misuse of Drugs Acts, 1977 and 1984. This forms part of the measures necessary for the transposition of Commission Directive 2003/101/EC relating to the manufacture and placing on the market of certain substances used in the illicit manufacture of narcotic drugs and psychotropic substances.
