S.I. No. 50/2004 - European Communities (Labelling and Marketing Standards For Poultrymeat) (Amendment) Regulations 2004

1. These Regulations may be cited as the European Communities (Labelling and Marketing Standards for Poultrymeat) (Amendment) Regulations 2004.

2. The European Communities (Labelling and Marketing Standards for Poultrymeat) Regulations 2004 ( S.I. No. 42 of 2004 ) are amended by substituting the following Regulation for Regulation 4—

“Labelling

4. (1) Subject to paragraph (2) and notwithstanding the European Communities (Labelling, Presentation and Advertising of Foodstuffs) Regulations 2002 ( S.I. No. 483 of 2002 ), a person shall not offer poultrymeat, other than pre-packaged poultrymeat, for sale unless it bears the following indications—

(a)  the class as referred to in Article 3(1) of the Council Regulation,

(b)  the price per weight unit at the retail stage,

(c)  the condition in which the poultrymeat is marketed in accordance with Article 3(2) of the Council Regulation,

(d)  the registered number of the slaughterhouse or cutting plant, and

(e)  in the case of poultrymeat imported from third countries, an indication of the country of origin.

(2) This Regulation shall not apply where cutting and boning of poultrymeat takes place at the request and in the presence of the consumer.”.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These amended Regulations require further standards for Labelling in compliance with European Union legislation on the marketing standards for poultrymeat. These standards concern such matters as class, price per weight unit, condition and registered number of slaughterhouse or cutting plant. The Regulations also create penalties for non-compliance and provide for the authorisation of officers to conduct inspections.
