S.I. No. 659/2003 - European Communities (Port Reception Facilities For Ship-Generated Waste and Cargo Residues) (Amendment) Regulations 2003


I, DERMOT AHERN, Minister for Communications, Marine and Natural Resources in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Directive No. 2002/84/EC of the European Parliament and of the Council of 5 November 2002(1) , hereby make the following Regulations:

1.        These Regulations may be cited as the European Communities (Port Reception Facilities for Ship-Generated Waste and Cargo Residues) (Amendment) Regulations 2003.

2.        The European Communities (Port Reception Facilities for Ship-Generated Waste and Cargo Residues) Regulations 2003 are amended as follows:

 (1) in Regulation 2 (1)

(a)  by substituting the following for “MARPOL 73/78” “ “MARPOL 73/78” means the International Convention for the Prevention of Pollution from Ships 1973, as modified by the Protocol of 1978 relating thereto, done at London on 17 February 1978, in its up-to-date version”;

(b)  by substituting the following for “Directive” “ “Directive” means Directive No. 2000/59/EC of the European Parliament and the Council of 27 November 2000 as amended by Directive 2002/84/EC of the European Parliament and of the Council of 5 November 2002”.

EXPLANATORY NOTE

These Regulations amend the European Communities (Port Reception Facilities for Ship-Generated Waste and Cargo Residues) Regulations 2003 in order to improve and accelerate the implementation of Community legislation on maritime safety, the prevention of pollution from ships and shipboard living and working conditions.
