S.I. No. 361/2003 - Arramara Teoranta (Transfer of Departmental Administration and Ministerial Functions) Order 2003

The Government, in exercise of the powers conferred on them by section 6 (1) of the Ministers and Secretaries (Amendment) Act 1939 (No. 36 of 1939), hereby order as follows:

1.         This Order may be cited as the Arramara Teoranta (Transfer of Departmental Administration and Ministerial Functions) Order 2003.

2.         In this Order -

“Acts” means the Arramara Teoranta (Acquisition of Shares) Acts 1949 to 2002;

“functions” includes powers and duties.

3.         (1)        The administration and business in connection with the exercise, performance or execution of any functions transferred by Article 4 of this Order are transferred to the Department of Community, Rural and Gaeltacht Affairs.

(2)        References to the Department of Communications, Marine and Natural Resources contained in any enactment or instrument made under an enactment and relating to any administration and business transferred by paragraph (1) of this Article shall, on and after the making of this Order, be construed as references to the Department of Community, Rural and Gaeltacht Affairs.

4.         (1)        The functions vested in the Minister for Communications, Marine and Natural Resources by or under the Acts are transferred to the Minister for Community, Rural and Gaeltacht Affairs.

(2)        Reference to the Minister for Marine and Natural Resources contained in the Acts and relating to any functions transferred by this Article shall, on and after the making of this Order, be read as references to the Minister for Community, Rural and Gaeltacht Affairs.

5.         References to the Minister for Communications, Marine and Natural Resources contained in the memorandum and articles of association of Arramara Teoranta, shall, on the making of this Order, be read as references to the Minister for Community, Rural and Gaeltacht Affairs.

6.         All shares of Arramara Teoranta standing in the name of the Minister for Communications, Marine and Natural Resources, before the making of this Order, are, on the making of this Order, transferred to the Minister for Community, Rural and Gaeltacht Affairs.

7.         All shares in Arramara Teoranta transferred to the Minister for Community, Rural and Gaeltacht Affairs by Article 6 of this Order which, on the making of this Order, are standing in the name of the Minister for Communications, Marine and Natural Resources shall, on request of the Minister for Community, Rural and Gaeltacht Affairs, be transferred into the name of the Minister for Community, Rural and Gaeltacht Affairs.

This Order transfers to the Minister for Community, Rural and Gaeltacht Affairs and to the Department of Community, Rural and Gaeltacht Affairs, respectively, with effect from the date of this Order, Departmental Administration and Ministerial functions in relation to Arramara Teoranta.
